@Dave Bond In my experience, New Mexico is a (very) tenant friendly state.  I'm not an attorney, but would direct you to Sections 47-8-1 through 47-8-51 [47-8-52] of NMSA 1978 also known as the "Uniform Owner-Resident Relations Act". 

To the best of my understanding, the absence of a written rental agreement does not mean there is not a rental agreement in place -- rather, the occupancy agreement defaults to the provisions of the Statues referenced above.  These statues summarize defaults such 30 days leases, rent rates/late fees, and an owner's rights to repossess.   Keep in mind the Statues do apply to the owner (you said you're in escrow so presumably that's not you).  You inherit the responsibilities/agreements of the owner when you take title to the property.

Sounds like a bit of a sticky situation, I'd talk to my lawyer...

I am one of a team of three Albuquerque based real estate investors / wholesalers.  We own investment properties all over Albuquerque, multis/condos/townhomes/SFHs in all sorts of price ranges.  Almost all of our deals are procured direct from the seller and our returns are usually 9CAP or better.  Send me a PM if you'd be interested in learning more about us, it would be awesome to hear how NM compares to Costa Mesa from your perspective, and fill you in a little bit about what we do.  Maybe we could set up a Google Hangouts to introduce ourselves?
