Like most things in life its probably a case by case basis.  If they've previously been a strong tenant, working with them to help them on their way or until they are back on their feet may be more effective than eviction.  Being in California if the S hits the fan again I wouldn't expect very friendly eviction proceedings.

@David Kelly to quit claim deed the property into the LLC, would the loan have to be assumable? I was under the opinion that most mortgages these days were not.

My partner and I are purchasing vacant land in San Bernardino County with the intent to build a fourplex (or really two duplexes) one single lot. The lot previously had a house on it and would be infill in a predominately SFR neighborhood built in the 70s. Does anybody know a lender providing construction loans in this area? Questions we are looking into: If we purchase the property through an LLC (or Corp), are we going to get a less favorable construction loan rates? The concern is with that sort of institutional set up we'll be required to have a non-recourse loan and not able to take advantage of the current low mortgage rates when we refinance after construction is completed. Would a partnership be more favorable until after the initial refinance? Could the LLC then assume the mortgage?

I was wondering if there are any property managers in the San Diego area that specialize in transitional housing.  I'm looking for somebody in this sector as its a niche that comes with its own challenges.

I got a similar flyer from them and was curious what sort of stake they were taking.  The 40% stake for future appreciation doesn’t seem horrible if you feel the market has plateaued.
