Thanks for the detailed reply.

The second option seems more likely as our target area is in the older neighborhoods of the town. Rehab isn’t going to generate the profits we are aiming for though. High end homes have the best return in our target area. The new house isn’t going to look anything like the old one!

Based on what you guys say the only option is renting the old house out for 12 months or so. The construction takes around 10 months, so a total of 24 months holding closing to closing.

If this model works, then I need to calculate tax savings vs project delay of 6-8 months to see if it’s worth it.

And how would IRS figure out the intentions? Would listing for rent before and after building be considered good evidence? Our company is series llc. Different series for construction and rental.

Renting out after re-building is going to impact the sale price, so not a good option. We currently have a tenant in the old house,  though and the whole project will take 18 months or so.

Thanks for the reply. It’s not a one off concept , at least that’s not the idea, but this is our first!

We paid all cash, we don’t think that the gain is going to be anything close to what we’re going to pay for the next home!

We can afford to rent the old house out for a while if it helps for the holding period etc.

Hello experts,

I was wondering if a single family new construction project could be structured to benefit from a 1031 exchange. If yes, what’s the requirements?

Concept: buy an old house, knock it down, build a new one and sell. Skip the tax for now until business generates enough income. Or any other creative way to delay the tax bill?!

The one that gives you longest no interest period, use it as interest free loan for a  of years. Put all your life expens you can on the card and save your cash for investment!
