I've had a couple loans we foreclosed where there were medicaid liens.  The lien gets wiped as long as it was recorded after the lien foreclosing.

That's what I assumed but just wanted to make sure because I have not purchased one with a Medicaid lien myself. Thanks for the information!

Hello,

I'm looking into purchasing a foreclosure at auction(Alabama) that was foreclosed by the mortgage lender, however, this property also has a Medicaid Lien on it. Does anyone know if I would be liable for this lien since I'm not affiliated with the previous home owner? I've done a lot of research online but have been unable to find a clear answer. Medicaid liens don't have a set amount due to them being ongoing expenses. I've read that Medicaid liens are considered "unsecured" liens so maybe this will help. I don't want to get the property at auction and then end up owing a lot more to Medicaid. I know some of these rules may vary by state, but hoping someone has experience with this.

Thanks

Your post is slightly confusing as you note your looking to purchase at auction that was already foreclosed on by the mortgage lender. Was the home already foreclosed? IF not you should run a title report and have an attorney advise on the title and confirm the loan being foreclosed on is a first with no other superior liens. Typically to answer your question a medical lien is inferior to a first mortgage and would only get paid after the first gets their money but the buyer would typically not be responsible for a medical lien.

Yes, it is a foreclosure auction. The mortgage company is who is foreclosing on it. When I checked the records I noticed there was also a Medicaid lien. I figured the Mortgage company would be superior to the medicaid lien but just wanted to be sure I wouldn't be on the hook for any of those medical fees as well.
