@Thomas S. these people have a list as long as my leg of prior evictions and judgements  against them.  The chance of me getting any money out of them through a judgement looks pretty slim.  I spoke with a previous landlord of theirs and prior to be evicted they kicked in all the doors in the property.  I am pretty sure that my property will receive the same treatment and am trying to keep this from happening.

So, I have committed the cardinal sin of land lording.  I did not do my due diligence and now have a set of tenants who are habitual evictees.  These people have been pretty terrible and now the crap has hit the fan and I am going to have to get them out.  I have contacting one of their previous landlords and talked with him and the diagnosis isn't good.  They kicked all the doors in in the home as they left. 

I am wondering if trying the cash for keys with these folks might be the easiest way to get them to move on and looking for some feedback on how to proceed with this in the best way possible.

Man, thanks everyone for their inputs into this situation.  I know that I should never let the late payment slide and yet, against all the things I have learned from books, BP podcast, and BP I still did not act on my knowledge, GRRRR!  Brandon Turners line rings in my head "you wouldn't pay someone's mortgage for them would you? that is what you are doing by letting a tenant pay late and not charging them".  Trying to be a "good old boy" in this business will get you ran over quickly, I am finding out.  This is a great learning opportunity and after I get this deal straightened out I will be a little wiser the next time around.

A little side note, this was my first investment property.  The tenants in the other side have been amazing.  I receive their payment 5 days early and never hear a word from them.  My first rattle out of the box I got the dream tenant and the less dreamy.  My second property which I have a great tenant moving in Monday will have a M2M lease.   The consensus seems to be M2M, that's the way I am going from here on out.

Their request this month is for me to change the locks on the patio door to the same as the front door of the apartment.  I get these requests over text message and this time I text him back and asked him to give me a call so that I could better understand what it is that he was needing.  That was 24 hours ago and haven't received a call.  They have been late on their payment 2 months in a row and I haven't charged them the late fee in an effort to show them that I really do care but doesn't seem to have any effect on their horrible attitude ls towards me.  They make their payment at the bank and they were so rude to the teller that I received a phone call about it. I think I will continue to kill them with kindness as David mentioned, that's more my style anyway.

I am sure I missed some serious red flags on these tenants in the screening process and I am gonna pay for it now.  I am almost positive that these folks are not gonna adjust their behavior and my only option is to get a little more hard nosed with them or else continue letting them run over me.

I have a tenant who suddenly finds something wrong at or around the time of their monthly payment.  This has been the case so far every month of their lease.  I have fixed these minor issues within a day of them telling me about them every time.  I am beginning to believe this is on purpose and their way of making life a little less easy for me.  I am really new to the business and have bent over backwards to make these people happy and it seems that isn't possible.  What do I do?

@Account Closed How detailed does the letter need to be.  You didn't meet the income requirements, you didn't meet my credit score minimum, your back ground check did not meet my standards.  Things along these lines?

Okay, how do I deny an applicant in the right way, the lawful way, the moral way.  Say I have 10 apply for the property and one stands out as the perfect tenant.  How do I proceed with letting the other nine know they have been declined.

@Sean Morrison my ignorance in this area is beyond embarrassing and has been put on public display. I like to look on the bright side of things and all the input I've received from the BP family has been amazing. From now on I will be much more wise in this area of the business.
