What concerns me is your lack of concern for the home owner "force the property owners hand"!! Have you tried to establish some form of communication with the home owner or did you go in with both guns blazing with your offer? Don't get offended but it's your own comment that has me wondering.

Supplemantal Directive 09-09
Notice that the sale must represent an arms length transaction and that the purchaser must not sell the property within 90 calender days of closing, including certification language regarding the arm's length trancaction that must be included in the sales contract.

Has anyone run into any issues regarding this in an A-B-C transaction?

Would full disclosure and as long as the bank accepts the contract supercede any Hafa issues especially if your trying to use Hafa to the home owners benefit.

This is interesting as the investor that I work with has been thinking about doing this as an incentive for realtors to bring in shortsales. I know one guy has been pushing this to the investor and he's a realtor himself and was a lawyer at one point in his life.

and were still talking A-B-C.

Could there be some form of consulting fee if the listing agent brang the c buyer?.

If public record states a motion for default and then default issued is it too late to get the bank to do a shortsale on this property.

The property is located in Florida.
