Thank you all for the great feedback! I found it very helpful. I will dig into some of the references made (and try not to get lost in the process). As always, I appreciate the time you've taken to respond.

Hey @Nick Keesee, the way I interpret what I've read and researched is it should be compliant. Thank you for the input on the Howey Securities test, I will definitely give that a look. Thanks again!

What are the rules for advertising to attract private Lenders. I've attempted contact with 2 different sec attorneys, and I just get the run around. Can I post something along the lines of: "Current investment opportunity available. 10% Return secured with 1st position Mortgage/deed of trust at a Low LTV. Contact me for further details". Thats all I want to know. Thanks! Any knowledgable feedback very much appreciated.

Post: Seeking advice on how to secure private lender for auction purchase

Hello everybody, I have a quick question regarding protecting my lender for an auction property purchase.

I have a lender willing to fund an auction purchase for me, however she is on the East Coast and cannot be present during the auction.

How do I set this up so that I can:  1. purchase the property and 2. keep them secured at all times during the process?

Does that make sense? ;) Any input from somebody with experience doing this is very much appreciated! Thanks.
