I have a tenant that was supposed to be out before the first. On the first she was still moving out and than when I inspected the house a few days later it was infested with cockroaches. I had an exterminator come out and started a treatment but could not rent the property out mid month I had to postpone till the following month. Can i deduct the 15days of unpaid rent due to having the property treated? This is San Diego, CA

@Colleen F. Yes sorry it is a termination of tenancy. Laws of California require that I give a 60day notice if the tenant have lived in the home for over a year. I’m just unsure of now how to handle him not wanting to leave on the first of September.

@Waylon Zook it would be a non renewal of lease.

Good afternoon! Looking for advice on a tenant who I sent an eviction notice 60days ago and today I was told he was not moving. He states he spoke to a lawyer and they told him he did not have to evict since the notice did not state a reason for the eviction. Tenant also stated he had mold in the closet which was due to a leak that was fixed back in may and this week we will be addressing the mold. He states I should have provided him with more time since he has lived in the home for 7 years and although he has looked for a home to rent he has not found anything currently. Property is in San Diego, CA. Looking for any advice or similar situations. Just some more back story tenant has made many changes to the property without prior approval and is currently on a month to month since no lease has been renewed for quite a few years. Reason for the eviction is 1. the house is not renting at current rents and 2. Bathroom needs re piping and complete remodel. Tenant has paid rent every month.

I have taken over my parents rental properties in San Diego and they haven’t been managed properly. I have a few questions I’m hoping you can help me with.

1. Non of the tenants have updated contracts which I’m working on updating. Can I issue a new contract and date it for the following month so I can increase the rent?

2. Anyone have any advice on having a company do an inspection before renewing contracts? During this covid time has anyone run into issues?

3. One of the properties has items on the front porch that I would like removed but she is under section 8.. can I issue a contract of my own and have her remove the items within a set time frame?

4. Another tenant has a big front yard that used to be parking spots..has anyone ever asked a tenet to remove personal belongings so that I can make them parking spaces once more? It has become an issue with tenants having front and back yards they have put boards up or sheets to not allow the other tenants to see and it makes the properties look horrible. I was thinking of just removing all of the gates and making one community area.

Please let me know if you have any books or if you have any vendors in mind for property located in National City, CA.
