Greg H. - Thanks for your response. Unfortunately I am getting several answers that are contradicting each other. I met with a real estate forum and asked the same question and the people in that meeting stated that I can use my spouse to buy HUD homes and that they have done it as well. I will keep researching.

I believe the company, Berkshire Hathaway, does list some HUD homes in the metro Atlanta area. If a HUD home is listed by another company then would that be acceptable?

My wife's broker is stating that is against HUD policy for a spouse being a buying agent for their spouse. I have not found that on the HUD website yet
