Steve, I didn't write this originally but one of the applicants is Somalian, another Black, and another white - my reasons for denial have NOTHING to do with this but I'm afraid it could be perceived that way. 

Thanks, Jon! So similar to what I was asking with Colleen - how do I communicate in few words and deny the application? They still haven't submitted an application at this point - do I let them submit and then deny? What if they pass all of my other criteria or ask for more info on denial and it becomes a my word vs. theirs. 

Sorry for all of the questions that may seem novice, I just want to do it right and not have any issues. 

Thank you Colleen, that is very helpful! Yes I'd be amazed if I got 3 fully completed applications in from them too. I will definitely broaden my criterion with your suggestions. With this property it is bizarre to be in this situation in the first place and that's why I don't think I have those type of things in my criterion up to this point.

So when they then ask for an application what do you do? Let them fill it out even though I know before they apply they haven't met my criteria of not showing up under the influence of drugs or alcohol. How do you professionally and rightfully respond when you say they aren't qualified and keep it from becoming my word vs. theirs (e.g. Me: You were high; Them: no we weren't). 

Hello, 

Ran into an interesting situation tonight and wanted some advice on what to do - I appreciate your time and thoughts in advance. 

Currently marketing a unit for June 1 that is a one side of a duplex. It's posted for $2200 and I have my standard credit, background, and income-rent criteria.

I showed the unit tonight and everything about the showing gave me the gut feeling of "don't rent to these people." They (3 roommates) showed up clearly high and smelled like weed and slurring their words. One of the high people commented on the way out the door "these stairs seem dangerous like someone might trip and hurt themselves." The stairs are perfectly in tact and safe with no obvious issues, they were just having a little trouble putting their shoes on in the split entry without falling over because they were high. Someone mentioning that, to a landlord nonetheless, would lead me to think they might be frivolous.

They are interested in the unit and want to apply and I currently don't have any other applications in right now. I'm afraid that in the application they may pass all the "criteria" pieces but I still know it is not a good fit. I feel as though renting to them would be a mistake but I want to legally and rightfully deny them. 

How would you proceed?
