If I don't receive payment today I'm going to hand them the 3 day notice. I've decided to go with a non payment eviction vs lease termination. I've read that they typically move faster in the courts.

Sunday I offered her deposit back and to wave the rent for the month if she could move out. She declined. Monday after fielding several useless arguments they had I offered to reduce the rent to half. She said she didn't even have that. She said she would have the rent today. I'm waiting patiently but I'm highly doubting she pays.

Susan I drove over and removed all of the mold immediately!! Two small pieces of sheet rock. Underneath the tile floor was wet so to prevent any more possible mold growth I scraped the tile and trashed it. I let the floor dry and treated it with a product call mold control the next day. This was all Sunday and Monday. The rent was due on the 10th. I called on the 10 and she said she would have it Friday, she didn't. Friday she said she would have it Monday. Sunday at 6:45 pm she sent the text about the mold. I was out working at another property of mine so I drove over immediately.

Also the tub is just a few years old. I'm 200% sure the hole wasn't there before they moved in. She says it was and that she didn't think anything of it. She also says the mold was in the closet and she didn't think anything of it.

Thanks Micheal! The tub has a BB sized hole in the bottom of it right below the tub spout. The drain is near the center of the tub. It is resting on wood. The water seems to have followed along a 2x4 and overtime it got the floor underneath the bedroom tile wet. I removed all of the tile as soon as it was brought to my attention. Mainly to avoid anymore of the mold talk. Explaining to tenants that mold is everywhere and far less harmful to a healthy person than the media portrays is difficult. Especially when the rent is already past due and they don't want to pay.

Brian that is why I have been patient. She always pays late and with the late fee. Ive reached my breaking point with them. Who in their right mind ignores a hole in a bath tub ?

Billy I didn't do a background check but I did speak with the last landlord. She paid religiously

my plan of action is to terminate our lease agreement immediately. There is a damage clause that allows me to do so. Giving them 10 days to move. After the ten days I will file for eviction.
