I currently have an LLC in Florida. I am filing for a fictitious name to use for REI purposes. My question is, does the fictitious name need to have LLC on the end to keep the liability protection? I don't want to operate outside of the LLC protection by advertising a name without LLC on the end or will I be covered because my LLC will own the fictitious name? I appreciate any input on this.

I appreciate everyone's input.  I am going to try to find an investor friendly Realtor who may be more willing to write these offers regardless of whether they are accepted or not.

It is both. My agent wanted to call the listing agent before putting a written offer in because she thought it was too low.  The listing agent told her not to bother that the owner already turned down a higher offer.

Good Afternoon,

I am just starting out in the RE investment arena and have already hit a snag.  I found a property that fits within my criteria and I attempted to put in my first offer on an investment property.  The realtor will not let me put in a written offer because she thinks its too low.  She called the listing agent first who told her that the seller already turned down higher offers.  I had a conversation with the buyer while looking at the property and various circumstances led me to believe that she is highly motivated.

Would it be illegal to approach the owner directly with my offer?  I have no problem paying her listing agents commission and I am not trying to circumvent the process, I just want her to see my cash offer and not get shot down by her agent.

Any information would be greatly appreciated.

Evan,  we used Adams Homes (in 2013) to build the house we live in.  I would recommend them.
