 The problem is that they agreed to renew 90 days before the lease ends, but did not sign any renewal until now which is few weeks before the end of the lease. When i sent the lease for signatures he refused, saying she must leave. So the situation is that this happened very close to the end of the lease so i don't have much time.

Thank you guys, i spoke to my tenant, he thinks she will stay if he moves out, i am hoping i can avoid an eviction.

He is supposed to talk to his lawyer today, if she stays he will not be signing the lease so she cannot pay rent. 

Hi all, 

I have a couple with 2 kids living in my property, it's time to renew the lease after they have been living there for more than 2 years.

The male tenant says he wants to be on the lease by himself as they broke up and he asked her to leave, but the problem is that she refuses to leave. 

He is a great tenant, i don't mind extending the lease with him, but if she refuses to leave he won't stay.

1. Should i sign him and ask her to leave? she cannot pay rent by herself.

2. Should i ask them both to leave and look for other family?

I went there yesterday to help them carry their machines upstairs, i know it may sound strange to many of you but i preferred to help them out and be there than to have them carry the machines themselves and damage the property. I also wanted to take the opportunity to make sure they understand this is the last time this behavior is being tolerated. I flipped the switch, should she make another sound, the next step would be a letter to end the lease.

Wow, i decided to sell the set just to end this saga, sent two guys to pick the set up. She send me a text that they are not professionals and her husband told them what to do so she charges labor.

@Gabe S. On what grounds? i can't just terminate the lease, i have no witnesses to her behavior.

@Colleen F. The other partner witnessed this and at some point even came to block her from getting too close, he clearly noticed something isn't right there. I truly don't know how i am going to go there again. I feel like i am facing a long year of continuous nightmare with them. I truly hope it's a transition thing and they will eventually stop, but if not, i am just going to hire a professional to deal with them until they leave.

@Tim Miller Thank you, i didn't mention any expected behavior from tenant in my lease. What is she breaching if this happens again? I left there feeling i may need to file a complaint on assault.

@Colleen F. Thank you, i told them yesterday that they can move if they don't like the house and i am sure they do. The house is way over what they can get for what i am charging in the area. I offered to clean the machine but honestly, i was afraid she'd get violent. She came very close to my face and i am reluctant to go back there.
