Post: 1031 Exchange in Toledo

My elderly tenant passed away in January.

Her adult daughter continued to pay the rent till September on her deceased mother’s behalf to continue to have access to the house and her mom’s belongings.

She has now stopped paying the rent and has been unresponsive for weeks. She did not respond to a 15-day Pay or Quit notice either.

She is not on the lease, the property is vacant.

Can I simply take possession and change the locks? Or is there anything else I need to consider here?

My tenant passed away in January. Her daughter asked for time to clear out the house and maybe get some closure.

The daughter continues to pay the rent until September without being in the lease. She never lived there and the house is vacant.

The daughter now stopped paying rent and can not be reached. I placed a notice on the door and the mail and have not heard from her.

Since she is not on the lease, can I now simply take possession and change the locks, or do I have to go through a formal eviction?

Quick update: we settled on a free one year home warranty that covers any potentially upcoming plumbing issues. A licensed plumber certified that the bathroom addition is in fact up to code. The electrical permit has been pulled and inspection is coming up this week. I think we will move forward with the deal.

Hi guys!

My wife and I have a home under contract with a turnkey provider. This was a full remodel with new roof, all new mechanicals, complete bathroom gut. As part of the rehab a new bathroom was added.

Turns out that virtually no permits were pulled for any of the jobs. Not for the roofs, not for the electrical, plumbing repair and washer/dryer hook-up relocation, etc. The roof had all layers removed and one new layer of dimensional shingle installed.

I had the house inspected and the turnkey provider will fix a few minor issues before closing.

When I brought up the permits they offered to have the electrical work permitted, and the HVAC will be permitted when it goes in when the first tenant moves in. They are hesitant, however, to have the bath addition permitted, because they fear that the city will make them tear out the entire bathroom to inspect the plumbing.

Instead they offered to have a licensed plumber inspect the bathroom and certify in writing that the bathroom is code compliant. In addition the provider is extending the full home warranty to 60 days.

Alternatively the turnkey provider offered to refund our earnest money, if we are not satisfied with this solution.

We are generally happy with the quality of the job and like this house as a good investment.

Are we overthinking the un-permitted bathroom issue? What’s the worst-case scenario here?

Sec8 is good and bad. In that neighborhood it's the only way to collect a paycheck. Profits are very good, but the inspections are usually in favor of the tenant. Meaning, I have to pay all repairs, even the ones marked as the tenant's responsibility. The tenant simply wouldn't pay them, so I have two options: Fail the inspection and have the house drop out of the program, or pay and continue to collect healthy checks. I learned to live with the latter.
