Kent,

It doesn't work like that with Missouri title searches.  If it's not recorded with the recorders office or on Case Net your title company wouldn't pick it up.  In your case there was nothing to pick up since the lien was never recorded against the property.  It's just a matter of non-disclosure by the previous owner.  Unfortunately, if it's even worth your time, your best route would be to sue.  You could go small claims court since only $3k and wouldn't have to hire an attorney.  Most likely would win, but no guarantees on collecting.

Many attorneys in the St. Louis area will give you these lists for free.  I use Dale Sweet as my attorney for all things tax sale related.  His website is missouritaxsales.com.  If you reach out to him he will get you these lists for free as soon as they are available.

Hi Cindi,

I have been buying foreclosure and pre-foreclosures in the St. Louis area for the past 10+ years now and based out of St. Charles.  The best resource available is www.moforeclosure.com.  There are a couple other subscription sites, but this one is by far the best and cheapest.  Moforeclosure.com is the only site I've found that has all foreclosures across the entire state of Missouri.  I subscribe to the entire state, but I think you can purchase individual counties for only $25/mo.  They have pdf copies of the same legal notices you would find in the paper.  They also have mailing addresses for pre-foreclosure leads, loan amounts, etc.  It will save you a lot of time and money compared to buying all the newspapers.

Hope this helps!

Dan
