Do you know any lawyer or company that specializes in this security deposit small claim?

Section 8 inspector usually send report for failed items only. If nothing failed, inspector just told us that it passed.

Yes, I need to do more due-diligent checklist in the future.

Thanks for your help Kathy,

for the move-in checklist, I give it to tenant when she moved in 6 years ago, but she did not fill it neither returned to me. This tenant is a section 8 tenant, we passed section 8 inspection before she moved in.

Someone told me that California Judge is in favor of the tenant. Judge usually believe that tenant is a victim, and landlord is greedy. How could prepare for this?

Hi, 

Need your help for a small claim case in California.

A tenant moved out of my rental property recently. There are a lot of damages, property was very dirty. I sent her the move out statement which showing she owes money to us for the necessary repair and cleaning cost. She mailed a certified letter to request 100% deposit refund. We were unable to make a agreement with her. Then she sued me $1200 security deposit plus $2000 punitive damages in California Small Claim court. 

We did not have experience on small claim. Please advise how should we prepare and defend us for this case.

Is it mean that winning bidder may not get insurable title?Is it a potential risk to bidder?

Thanks for your reply, Jon,

Allstate agree to pay all other repair cost except this $4500, AllState told me that they could only pay this $4500 to tenant since AllState believe it is moving cost, and I need tenant's release agreement to release this $4500 to me, but tenant not willing to sign anything. Therefore, everything stuck, and all the repair delayed since I did not receive any repair money from AllState.

I could not find any solution for this case now.

Hi, 

My rental condo is on 1st floor, this unit was flooded because of upstair unit water heater leaking. I did not buy insurance for my unit, Upstair unit owner let me to claim to his insurance company-All State. The unit was wet everywhere, tenant has a lot of furniture, contractor needs to move all furnitures to storage before remove the wet carpet. But tenant does not has money to move out, My tenants complained to me that the smell was very bad because of 3 days wet. I contacted All State claim officer, she told me "It is your responsibility to do whatever to prevent any further damages". 

To prevent mold and further damages, I paid $4500 to a contractor to move all the furnitures to storage, and then removed the wet carpet.

After my unit empty, All State told me that they could only pay this $4500 to tenant because furniture is tenant's property. All State asked me to get tenant's approval to release fund to me. But tenant did not want to sign anything to release this fund to me.

I contacted All State and tenant for 2 months, but no any solution.

Any suggestion of solution to solve this issue will be much appreciated.
