I had an eviction order that was scheduled for April 1 but no with NYS postponing all evictions for at least 90 days... that won’t happen but the tenant did sign an agreement in court to be out April 1. With all that’s going on, what is everyone doing in similar situations? Reaching out/ sending a letter to tenant stating that rent is still due otherwise additional legal action can be taken after courts open back up?

Has anyone had any luck with mortgage companies if rent can’t be collected due to coronavirus?  On a similar note another tenant also just informed me that she was laid off due to coronavirus - she has money for April rent but said she’s not sure after that but applied for unemployment. Any other programs that I could refer her to that would help?

I feel like it’s easy for politicians to waive rent without solving the underlying problems like rental assistance and how will mortgages, taxes, etc. be paid! 

Happy to hear advice and what other landlords are doing.

With the new NYS rental laws, is it still legal to have an early termination clause in 1-year leases that state the landlord can terminate the lease with 2 month notice for any reason?

@James Mc Ree I am but unfortunately in NYS we are capped by law at the amount of late fees we can charge I believe either 5% of the rent or $50. So I’ve only been able to get an additional $50 out of her a month.

@Michael Ablan the problem with this unit is she is on a year lease so until that’s up it’s going to be very hard to get her out it seems like

One of my tenants has been consistently paying late the last few months. It started back in September when she said she was in the hospital, so I let it slide then she said she was getting “help” which ended up being emergency rent from the county that dragged in to October. I then signed a letter from the county that said they would pay September and October (which I still haven’t received a check for but finally finished processing).

Then last month (November) she didn’t pay and I sent her a 14 day demand for rent letter (new standard in NY). She then sent me a series of nasty texts but finally paid on the very last day of the 14 day period. On top of all that the other tenant in that house is saying she is harassing her about her garbage can and keeps moving it despite it being in a common area. She also left cigarette butts in the house which i sent her a cease letter for but can’t prove if shes still smoking in the house.

Now she is late again for December and has given another excuse. I’m going to give her another demand for rent letter but I’m really at a loss as to what to do here since she is on a year lease until April. From what I understand even if I take her to court for eviction she can pay up to the last day before the sheriffs come then she can stay. Any advice is much appreciated!
