@Chris Seveney - Makes sense, in hindsight I should've filed the eviction a bit sooner to try and get it done before the holidays. 

Thank you all for your responses! It's a bummer but it sounds like I'll have to wait this one out. It's especially frustrating considering that I'm living in the unit below. I've reached out to my attorney and they've said we're at the discretion of the court of the court to assign a officer. They're most likely very backed up. 

Hi BP, 

I am currently house hacking a duplex in Union City, NJ, and unfortunately, the tenant stopped paying rent a few months ago. I used an attorney to file for eviction and we had the court date towards the end of October. At the courthouse, the tenant signed an agreement to vacate the property by December 1st. However, they failed to do so and remain on the premises.

I immediately contacted my attorney, who filed a warrant for removal the next day. Since then, there has been no progress. My attorney informs me that they are waiting for the court to assign a court officer to post the warrant of removal on the tenant's door. It has been almost three weeks since the warrant of removal was filed.

For context, this is my first time going through the eviction process - Does it typically take this long in Hudson County and is there anything else that can be done on my end to expedite this? I've called the attorney and followed up via email but they've mentioned that they are at the discretion of the court and can't do anything to speed things up. I'm concerned that the delay is because of the holidays and I wont' be able to get the tenant out until the beginning of 2025.

Hi all - Thank you for all the help, a few quick questions:

I have the court date set for late October (done through the attorney). Once the court case commences and assuming it is in my favor, what would the next steps be? Can the tenant be removed immediately after? The tenants lease also ends in December, the court date seems to be cutting it close. What is the likelihood of it not going in my favor? 

Also,The tenant doesn't check his mail regularly, so I'm concerned he's unaware of the court date. Should I notify him directly, or is it his responsibility to stay informed? or leave as is and if he no-shows to the case, that's on him? 

Thank you everyone for the tough love. I've hired an attorney and have begun the eviction process! Hopefully we can get this sorted out as soon as possible. 

Thank you all for you advice! Based on what I'm hearing, I'm going to try to reach out to them one last and final time, they've been unresponsive for a week. If I don't hear back, I will work with an attorney to start the eviction process. They've partially paid rent last month but I have not received anything this month from them and won't accept any partial payments for August. 

Hello BP,

I'm currently house-hacking a 2-family property in the Hudson County area. I bought the home just over two years ago when interest rates were at an all-time low. When I purchased the house, the second unit was already occupied, and I decided to keep the tenant.

The tenant has been living there for the past 3 years and had not missed a rent payment until a few months ago. Since April of this year, they have consistently been paying rent late in partial payments. They typically communicate that they will be late and do end up paying the full rent plus the late fee by the end of each month.

Unfortunately, we've reached a point this month where they submitted a partial payment at the beginning of the month and have now become unresponsive and have not paid the monthly balance. I've tried reaching out to the tenant multiple times but have not heard a word from them over the past week. They are on a year lease that expires in December.

This is my first property and first time dealing with this issue. Experienced NJ landlords, how would you handle this? Would you recommend getting an attorney? I'd prefer not to go through the eviction process, but their lack of responsiveness leaves me no choice.

@Nathan Gesner - Storage Facilities sound like an amazing investment. I just ordered the book you recommended. Would you be able to share some details around the financing for the storage facility you bought a year ago? Or is it more suited for a cash buyer with a large amount of capital to unload like Michael? 

@Jonathan Soto Thanks for sharing. Yes, I have closed on the property! I was able to get 3.25% rate and happy with it.
