FYI:  Due to past problems with certain plumbing and HVAC contractors, the City may not accept inspections done by those companies, i.e. it may not be because the company doesn't want to work with the City--it may, in fact, be the reverse.  (The reason given by the City is that water heaters and HVAC systems have been "stickered" by those companies without actually being inspected or brought up to code or those companies have done work without pulling the proper permits.)  However, this may or may not be the case with the company you are referring to.

@Joshua B.  Thanks for clarifying my comment--my comments were perhaps to loosely stated as I was only attempting to get at the gist of the issue and not be technical.  A city will, however, treat the vendee as the owner if the property is rented.

Every state is different--check your state laws regarding security deposits.  In Michigan, the security deposit can be kept in any type of account.  If it is co-mingled with funds that are used for other purposes, the amount must be bonded (i.e. insured).  The landlord must tell the tenant which bank holds the money.  (But remember--this is Michigan!)

As the owner of a property using a land contract in Michigan, you are the owner and may lease the property out--unless your land contract agreement prohibits it.  (Since you are not the tenant, you would actually be the landlord in this case and would be renting it out to a tenant--not a sub lessee.)

Also, be aware that some city's frown on land contracts that are rented out...just check your local ordinances.

What does your lease say?  What does your state law allow you to do?  Have you sent them a warning letter and asked them to correct the violation of the lease (if it is one)?  Just a few things to think about.

Just be careful of all the online lease form sites that aren't affiliated with an association for rental property owners.  Many do not actually provide legal leases for each state--even though they suggest they do.  It's best to obtain one that has been used extensively in your state and has been tested in the courts.

I highly recommend only considering advice from those that operate in California.  All state laws are different.
