Actually he died in the bathroom and was half in / half out of the bathtub. The tub contained most of the fluids, but I am worried about blood contamination.

Thanks for all the input folks.
We do plan to return prepaid rent to the estate after expenses, however we believe that we must wait for a probate judge to decide to whom the money will be paid.
I'm not sure we should have allowed his daughter to remove his posessions
without probate instruction, but it seemed like the thing to do at the time.

Note to Minna:
The death in a way has caused a bit of a clean-up challenge, along with a real concern about sanitizing the apartment for the next tenant.
I'm not sure I want to leave that to our maintenance crew.

We would like to do the honorable thing, but my partner insisted we use that advance payment to pay the taxes on our 30 unit apartment building that he was a tenant of at the time. We are talking about several thousand dollars that we don't have readily available.

I would think we need to re-lease the apartment, and I also believe there may be probate issues involved.

I have had a tenant die 6 months into his one year lease that he paid in advance. Am I required to refund the balance to his heirs?
