I'd argue the place would burn down regardless of the 1 inoperable out of 5 total smoke detectors.

I think I will just have the work done and get sect 8 to start paying again. Deduct from the security deposit what they are responsible for. Evict next summer. I don't really want to deal with a vacancy right now. On the other hand they are not making the tenant uphold the terms of the lease agreement and I definitely don't appreaciate them thinking they can change my terms as they please. Sect 8 claims smoke detectors are my responsibility to maintain. They reviewed the lease agreement and gave it the green light but I guess they don't care what language is actually in it. Not sure how thats "fair".

I'll try to get to their office tomorrow morning maybe and dispute the stove issue.

Talk about not being grateful for 100% free rent and a free stove.. she now drives a red BMW by the way. lmfao, not sure how that works.

Hey BP folks, have a Sect. 8 issue and wondering how you would proceed. Ill try to keep it short.

I have 1 sect 8 tenant(never again) that I'm having an issue with. A few months ago she sent me a picture of what looked like grease flowing out of the stove and all over the kitchen floor. Claims she didn't spill anything and that the stove is "leaking" on its own. I ignored the stupidity of course. A couple days later she calls complaining the oven isn't working. Imagine that. Hot surface ignitors don't mix well with grease.

The home was rented with no appliances included, and the lease backs that. However being the nice guy, I had an old stove in storage that I needed to get rid of. So they got a free stove that worked perfectly. This was the only appliance present at lease signing and made clear it was not "included" It was also present during final sect 8 inpection. The inspector noted that the stove was there(apparently)

I told the tenant to repair or replace herself and reccomended a local appliance company. Fast forward a couple months. The tenant called sect 8 to complain and they determined it was inoperable. They have now ceased any further payments until its repaired. Claiming its included in the lease(which it isn't) They also did an annual inspection while they were there and noted a damaged electrical outlet, inoperable smoke detector(which tenants are responsible for) and a few other things. The tenant also has a past due water bill of 130 bucks. Shell pay it "when she pleases" is her response. lol

Tenant still refuses to repair stove, and I know they will refuse to buy a 10 yr 9v to remedy the smoke detector. There may be other issues they are responsible for like the damaged outlet, etc. I really don't want a vacancy right now, so I'm thinking of repairing these issues and deducting the costs from their security deposit. I wont be renewing the year lease and booting them out at a more favorable time next year. However if they don't pay the water bill they will be getting evicted regardless anyway.

Repair, deduct from security and get another 8 ish months out of them? Or get rid of the headache, nip it the bud and evict for water/non-payment?

Post: Charging tenant an eviction court appearance fee?

I tried to search this without much luck.

Anyone out there have stated in their lease a court appearance fee? Say the tenants don't pay and I have to file for eviction, I charge the incurred court costs to their account. They are required to pay the full amount owed plus the court costs if they want to stop the eviction.

Now if they still don't pay and I have to show up for court and take a day off work, etc. shouldn't I charge the tenant a fee for that? Say like a $200 court appearance fee if it gets to that point? Still wouldn't be enough to cover my lost wages and certainly not any of my time. Going to court and all that is definitely a cost of doing business but a cost incurred because of these tenants. I thought I read on BP one time that someone was charging this type of fee.

Correct, for CC payments they have to dispute it with their bank after the charge takes place and the money already transfers.  Banks typically side with their customer (your renter) before the merchant in those cases, so just be sure you have documentation that the tenant agreed to the charges if you go that route. 

Well they would log-in and pay whatever amount they type in(unfortunately buildium doesn't allow blocking of partial payment, hopefully they will fix that) Kind of hard to to say they didn't agree with it... sounds like a potential headache I don't want to deal with though. Thanks Nathan!
