Thanks Wayne for the feedback.  Do you know where that standard is detailed by law, rules, regulations?  I'm looking for a little bit more than just "everybody does it" kinda thing.

Thanks Wayne for your feedback.  What I'm getting from anyone that I ask is really a lot of opinions that aren't backed up by any rules, laws, etc. that actually give the agents/broker authority to do this. It's definitely not something that agents, brokers, or reg reps that I've talked to in both states know off the top of their head.  I'm also an attorney and even inquired about going the route of a New York broker paying me a referral fee as an attorney instead of a realtor, but that is backed by a bunch of case law that I don't want to stake my law license on.  Seems like a very simple transaction but becomes complicated because we are in two different states.

Thanks Lien.  I'm not asking about the actual fees. I'm inquiring about the legality of the transaction.

If anyone from New York or Florida that regularly does real estate transactions between the two states could provide feedback, that would be appreciated. I'm getting a lot of differing opinions from both real estate professionals and regulating bodies. Thanks in advance.

Can a Florida realtor receive a referral fee from a New York realtor or broker?  I reside and work in Florida and have an extensive network in New York in which I will be referring real estate deals to a broker up there, but I just want to make sure that we are following the rules regarding referral fees.
