Post: Collecting Double rents and late fees

I evicted tenants because the did not pay Jan or Feb rent. In my lease agreement it states that on the 11th a $25 fee is applied plus $10 a day that it is late until it is repaid. My question is, Is it allowable to charge 2 late fees of $25 and to charge 2 different sets of day charges? I am trying to say that late payment fees of $10 are still incurring for January and then late fees for Feb are also starting. Essentially it is 2 Late fees for Jan and Feb and $20 a day when it hits 11 Feb.

I am taking these guys to small claims court on the 23rd of March so will I be allowed to charge late fees until the court date?

Steve I did not have time to hire a company to do it, next time though I will defiantly consider it.

I am really looking for what I will be able to sue for. Right now I will be looking to sue for

Rent for Jan/Feb
Utility Bills
Small Claims Court Fees
Late Payment fees per the contract

The limit for small claims in Kansas is $4000, can anyone let me know if it would be possible to just go head an sue for $4000 and file the petition as lost rent for the remainder of the lease.

Steve thanks for your reply.

For the military, we are obligated to pay for our debts. We get in trouble and can and will lose rank. My self and the tenant are both in the military. The great thing is that once a judgement is given, I can then go take that to the Finance office and I will get paid my money automatically as it would come out of the tenants paycheck. Essentially he will get no pay until his debt is taken care of.

My fault in this is that I did not screen the tenants. I was home from Iraq for 2 weeks and needed to get the place rented out as soon as possible because I did not want the house to sit vacant for 5 months until I came home for good. I was telling myself the whole time that if I wasn't so in a rush that I would of not of rented to these guys.

Simply the tenants could not afford the property

Long story short; I rented out my home to a couple and their mom that started on Nov 1 2010. I used the model lease agreement provided by BP which covered everything. I received rent for Nov and December. I did not receive rent for Jan and then now I have not received it for Feb. I told them to move out a couple weeks ago and they are getting out today. Also they had not transfered all the utilities into their name so I had to use the security deposit to pay for it. They are in the military so this will be too easy to get my money but I just need to know what all that I can sue for when I go to small claims court. Rent for Jan was $1000, rent for Feb was also $1000 but they stayed half of the month to the 14th so I am assuming only $500, am I entitled to the full month of rent? Utilities now range into the $450-500 range, I communicated solely via email, my lease agreement has them locked in for 1 year and they still have 8 months to go but I evicted them. So I was wondering if I could also sue for property manger fees to get a new tenant into the home and anything else.

Please advise BP!

Have you ever thought about setting up a networked hard drive? I have a DNS 323 2 bay enclosure with 2 2TB harddrives for a total of 4TB. I have it hooked up into my wirless router so that I can stream media, photos and documents anywhere through out the house over the network. The best thing about it is that you can easily set it up as an FTP server where you can acess it from anywhere in the world with a internet connection, you just type in the website name which is free and it links you to the harddrive where you can acess the info. Check it out on youtube and other reviews. I think it will be the cheapest option for you in the long run.

Thanks everyone. My mom is 42 and still has my brother who is in college with 2 years left and my sister who is 10 y/o that is still living in the home. She will be getting child support until my little sister moves out to the tone of about 2500 a month. That will be able to cover mortgage. She has had a stead job as a bank manager for a while so I think she will be doing fine. I dont think selling the house would be the best idea because my brother and sister are still living there. I would imagine that it would make it even harder for them if they had to move.

Possibly my first opportunity to get into real estate. Unfortunately my parents are getting divorced after 18 years. Their house which was appraised last year at 630k is now appraised at 545k. They owe a little over 20k. My mom will be keeping the house because dad will be moving out. She will be giving him 200k. Now is order for my mom to give dad 200k is to take out a mortgage. She is planning on taking a mortgage for 200k plus the remaining current mortgage balance of 20k plus about 40k extra to completely pay off credit cards and lawyers. In all she is planning on taking out a mortgage for 280k. So is there any other way to do this, possibly get me involved so I could get my feet wet and it will benefit my family as well as my mom> What kind of different loan options are there. Im trying to say, is what is the best route to take?
