Hi Everyone! Closing went GREAT!! 

Three units signed new leases with the understanding/documentation to start paying electric/base board heat. AND the hoarders, we gave a non-renewal of lease.

All is Well!

Terrific conversation here! Thank you to Everyone who Contributed, 

I was able to get the leases a few days ago and looked them over VERY closely! All amounts were disclosed and the security/pet deposits collected will be deducted at closing. 

As many had stated, I will be implementing the rent increase mid Spring, when Winter breaks. Then the 'shell-shock' will be more sustainable. 

As of now, the leases either expired or were written for month-to-month agreements. The 'hoarders' specifically were allotted 3 cats and two adults, and simply are now breaking the agreement.  I am very aware and project that they will not go peacefully in the least, and would like to start renovations with their apartment, as it will surely need the most help.) 

So beginning there, I will create a Notice to Terminate Tenancy. 

@George Paiva, the meters are already separated, thankfully, however the previous landlord felt the need to pay utilities out of pocket. Each unit has electric baseboard heat, which will be better maintained once in the tenants names. @Ralph R. I understand the question as if they wouldn't put utilities in their name, and if that is the case, the monthly cost will be added to their rent. This is will be added to the lease agreement as well, for our protection. 

@Russ M., All of Wisconsin may not put unpaid utility bills on the tax roll, however the utility provider where we are located, Shawano Municiple Utilities, unfortunately does. There is also a landlord revert in the event someone would leave their unit. 

@Amanda Palmer, I would be very interested to speak with you more about the steps to be taken if we were an LLC.

So in the meantime, my plan is to meet with the tenants and sign leases compared to their original move in date. I would like all leases roughly end around April, where the worst of Winter is over. In the meantime utilities will be introduced, upon the signing of the new lease. If tenants choose not to agree to the new lease, then we will go forward with the Non-Renewal of Lease and/or Eviction process.  

This transition will hopefully be well respected, as we are trying to get the tenants to make the ultimate decision, instead of someone new automatically kicking them to the streets.

Hi All, 

I am closing on our deal this December 30th, for a 4-plex. It is currently fully rented, which is great!

HOWEVER, as it sits, the landlord currently pays all utilities, (which will be changed immediately into the tenants names) and rent is low. I plan on meeting with each unit and having them sign a new lease, (they should be on  month to month currently), with a raised rent and acknowledgement that utilities is now on them. 

I see this as being an issue for some, because who REALLY wants to pay heat in WI if it was being provided!?! But neither do I! I'm just thankful the building was already set up with 5 meters, one being the common area. 

In addition to the two relatively HUGE changes, one of my units is a hoarding family with eight cats. (2 Bdrm/1 Bath) A quick walk through, determined the bathroom needs to be fully gutted and started fresh. There were many boastful comments about not paying utilities, and everything was included.

So assuming they do not agree to our lease/rental agreement......  is there anything to protect ourselves in the event they retaliate and do not pay rent and/or the heating bill? (Utilities go on our tax rolls if not paid by the tenants.) 

We have had an eviction proceeding in the past, and the judge left that family in the unit for a few extra months, because it was cold. I feel like these specific people are going to truly take me through a course of fighting me to get out. 

The offer did NOT state any contingencies on eviction. So I've looked at many discussions about the tenants having 30 days to find a new residence BUT what if they refuse to leave? What are our rights? Should i contact a lawyer and have them send a letter? I am used to working with difficult people but with this situation I am trying to time it out appropriately to avoid multiple vacancies at once!
