My tenant's son turned 18 mid lease contract.   He is listed on the Section 8 contract as a "Child/Occupant".   He has become verbally abusive toward my tenant and has had two instances of destructive behavior.  He smoked in the house, which is strictly forbidden and decided it was a good idea to put the butts out on the white vinyl sill.  The window now has to be replaced.    Several months later he threw something through the front window.   The tenant quickly replaced the window before I was notified.    She has now approached me asking if I can evict him.   I asked her if she told him to get out and she responded that he threatened to break every window in the house.    I'm not really sure how to proceed.   Can I legally evict or eject him?  Is it the tenant's responsibility to remove him from the house if she so chooses?  His threat is apparently in a text message, but I do not currently have possession of that message.  Any advice as to a direction I should consider pursuing would be greatly appreciated.

I currently do not have either a specifically stated "no roof" or "no trampoline" clause in my current lease.   Do I have legal justification for sending a 10-day cure notice?

I received a complaint from a neighbor that my tenant's son was climbing on the room of my single family rental (Section 8 in NJ).   I didn't see it happen and at the time had reason to question whether the accusation was true.    I confronted my tenant as a conserned parent and explained that I first and foremost didn't want anyone getting hurt.   I then explained that if true, the behavior was unacceptable.  She spoke to her son and he swore that he wasnt on the roof. Fast forward to this week. I received a complaint from 100% reliable source that the tenant's kid was not only on the roof, but jumping from the roof to a trampline.   I don't want to necessarily evict this tenant, if thats even possible, but I need this behavior to stop. What are my legal rights and have any of you experienced this before?   I cant find anything any law that directly addresses this type of behavior.

So hypothetically speaking.  If a tenant was to sign a S8 lease AND and second lease with the property owner, only the S8 lease is valid?  For example, S8 lease covers $1650 and second lease specifies $1700.  Total ask is $1700.

I have been spending the majority of my time trying to learn as much as I can about REI. I currently own and rent out one SFR and intend on growing that number over the next couple of year. The tenant requested and has received grant assistance, but there is still an outstanding balance of $150, only about 9% of the total SD.   Also, the tenant only pays 2.5% of the rent.   So even if I chose to evict, Sec 8 will continue to pay as long as I'm compliant with the HA lease and the tenant still lives in the house.  So I guess this is more like 'extending the olive branch' to keep things amicable.      

I am making her sign a letter stating that its a loan with a repay date and a monthly fee if not paid back in full.   

Section 8 in NJ is not accepting new applicants at this time.  Therefore, good standing with the Sec8 office is coveted by current participants.

caveat emptor Sec 8 inspections likely to find the gas (ie, stove) 'doesn't work' and stop payment of rent disbursements  if tenant fails to clarify that it was shut off (if it ever were to be) due to nonpayment. 

by the way OP, do you provide your tenant with annual sec dep interest credit, or are you exempt?

 The NJ Statutes do not distinguish between Sec8 and non Sec8.  Simply states the credit is paid annually via cash out or apply to rent.

Hello BP members. I am new to BP and have been a landlord of a SFR since 2012. I rent to a Section 8 tenant that likes to keep the heat at 80 degrees. Which is fine since the tenant pays the gas bill. I warned them that they should expect very high gas bills if the heat was kept that high. Well, last week I received a request to assist with paying a portion of the past due gas bill from the security deposit. I'm a reasonable landlord that is willing to work with my tenants, so I drafted a letter informing them that I will assist in the form of a loan that carries a monthly fee if not paid back by a mutually agreed date. So my question is, should I require the tenant to sign up for the gas companies monthly payment plan as a stipulation of the loan?
