AS AN AGENT, you can do this in a way easier way. Our whole job is to broker deals between buyers and sellers. So, my teams two ways of "wholesaling" is: 

1. Permission to show: Say you have a seller is willing to sell a property but they don't want it listed and don't want to be represented. Well, you can get them to sign a "Permission to Show" that will have the price they are willing to sell, and what your "wholesale" fee would be. This could be a dollar amount or a percentage. In this scenario we represent our buyers with a Buyers agreement and send them the deal and get it wrapped up. Now, you can not "market" this deal to the public, but you can to your buyers list in which you have representation with. 

2. Pocket listing: Say the seller does want to sell, but they just don't want to list it on the open market. Here you can get them to sign a listing agreement. Here you would have to put it in the MLS if your are with NAR, but it wouldn't syndicate out to all of the public sights, and you can send it to any potential buyer that you may know. Again the seller knows how much you are going to get paid and how much they are selling for.

The biggest thing is don't defraud the public, and disclose all. There is way more things that can be covered and any attorney can correct me on here, but these are the ways we understand how to make it work. Wholesaling is risky, because there are a ton of bad players out there, and so most brokerages don't even allow it because there is so much risk, and the principle broker is risking their livelyhood. 


Interesting point!  I've never thought of a permission to show as wholesaling, but I guess it's fairly close now that you point it out.

so basically, it is illegal for a realtor to do this in arkansas? I would get into trouble? Is there a legal way to do this? Like could I still list run down properties but just sell them to investors? Thank you for the feedback. I appreciate it!

 Your Broker has the ultimate decision on whether or not you can do it.  I don't know how you uphold your fiduciary duties while wholesaling without running into ethics issues.

If you're wanting to wholesale, drop your license.  There is no way you can do both in Arkansas.  I don't know a single broker who would allow an agent to wholesale while hanging their license at their firm.  Way too much liability.  You can't uphold your fiduciary duties while wholesaling a house.

Hey @Craig De Borba!  I really like where your head is!  Everyone's situation is different, but here is what I would do in your situation:

Sell the duplex and 1031 into something else.  Due to the current cost of capital, I would be putting a large down payment on multiple properties. 20-25% isn't doing it for me.  I'd be somewhere in the 40-50% range or more.  If the right property came along, I wouldn't be against buying all cash.  My preference is just to spread my risk across multiple properties.  

I am biased in that I'm a Realtor in Arkansas and own several properties here.  If you have any specific questions about our area, feel free to DM.

I'd stick with what I know.  Buy long-term rental properties in my local area where I'm familiar with the trends and forecasts.  I'd probably spread that out over 10 single family/small multifamily homes.

Personally, $80k down on 10 properties and keep $20k/property for renovations.  Solid cash flow for that around here!

Hey @Arnuv H.!  I don't know any title companies local to that area, but you can call Heritage Title and Closing in Russellville, AR and see if they can help.  They've helped me with properties around the state!

Hey Derek!  If you are currently licensed, I would run your plan by your Principal Broker.  Wholesaling by licensed agents in AR is a very gray area and most brokers will not see it as an acceptable risk.
