Post: Direct Deposit HELP!

Hi, i'm in the process of creating a lease with an attorney and I need to give them an answer regarding how i want to recieve rent money from my tenant. I put a clause asking for my rent to be directly deposited in my florida bank account or through bill pay. However Iwas warned that in the even of an eviction, if the tenant has access to owners bank account and the tenant deposits money after eveiction has been filed, it would stop eviction and cost me more money. Also that bank account would become part of the exhibits during an eviction (I don't know what that means). Problem is: I live in PA and my condo is in florida. The last tenant just deposited it in my bank in florida. it wasn't a problem. Don't know what to do. Any suggestions? Thanks

Dave, did you purchase the landlord kit or did you just download the lease? I'm looking for it now and can't find just the lease. Also, would you advise that I buy the landlord kit. Sounds crazy but I'm trying to do the right thing. Thanks for your patience. Angela

Hi everyone, I'm living in PA and I have a condo in Florida that I will be renting out and I need a good lease. My new tenant comes from a family of lawyers. My last tenant just left and I ran into so many problems because the lease did not protect me as a landlord. My realtor got it from somewhere and it really was not good. It caused me many night sleeps and money. Does anyone have any suggestions where I could go to get a good Florida lease that protects the Landlord or does anyone have a Florida lease that they would like to share with me? I'm fine with writing my own but I want to make sure it coincides with the Florida Landlord Statutes. I want to start off on the right foot this time. Thank You! Angela

Hi John and everyon who responded. I appreciate your response and respect your knowledge. Thank You. John, You asked what my lease read in regards to showing my condo. It reads "Landlord /Agent may enter the PRemises to Inspect or ehibit the PRemises to propective tentants under ANY of the following circumstances
1. Tenant's consent
2. When Tenant is unreasonably withholding consent.
3. In case of an Emergency.

She has agreed to have it shown after 8 and on weekends but has cancelled 8 already. She has also lied from the beginning about her big dog and her 2 cats. My Realtor also got her signature on a "Contract to enter into a lease of Real Property" form which reads:

"DEFAULT: If tenant fails to perform any of the promises on this Contract, the deposit paid or agreed to be paid by Tenant may be retained by or for the account of Landlord as agreed upon as liquidated damages, consideration for the execution of the Contracts, and in ful settlement of any claims, and Tenant shall be relieved of all obligations under this Contract."

My question is, she promised about 1 small dog and about agreeing to let the realtor show property. Can this be grounds for keeping her security deposit? What do you think? Thank You!

Hi, I'm a Florida Landlord and my tenant's lease is up on Sept. 30, 3012. We already agreed that she is leaving. However, she is not allowing my realtor to show it to prospective tenants. My tenant said that she is willing to give consent if an appointment is made and it's on weekends. Well, HERE IS THE PROBLEM: My realtor has been making appointments and already my tenant has cancelled 5 of them. She always has an excuse. I have tried to be nice but now I'm furious. It is now Sept. 9th and another weekend has gone by. The property is a condo and the new tenant must be screened and approved. Because of my tenants delays and uncooperativeness, I will not have a tenant in time for October 1st. What do I do? Is she breaching the contract by unreasonably withholding consent? Can this affect her security deposit in anyway? She also has a dog over 25 lbs and 2 cats which were not part of the lease. Although I approved the dog (after she lied), I did not approve the cats. I'm sooo upset and will now be out 2 months rent because of her being uncooperative. All comments are welcome. I respect your knowledge. Thank You!

I did sent a certified return reciept requested mail to my tenant on August 14th, 2012 to tell her that if she doesn't sign a new lease she must be out by Sept. 30 which is when her year lease is up. However, she never went to pick it up at the post office. A notice was left Now what do I do? She is avoiding me. Doesn't want to leave my apt. but wants me to lower the rent. Everything on her terms. She's really ticking me off. Thanks :)

Thank you for your positive response. I guess what I meant when I said "Do I have any recourse for her not letting me know?" is, if for some reason she is uncooperative with it being shown and I lose out financially because of it, can her security deposit go towards any of that? Also, what happens if she lives out her security deposit as her last months rent? I really don't have the money to go after her for anything. How do I deal with her security deposit regarding the cats? She gave me a $200.00 non refundable check for the dog but nothing for the cats and, how do I prove it? I really appreciate your knowledge. I'm in Landlord School 101 :)
