[State of PA]

I have a real estate wholesale deal under contract (fully executed purchase agreement), but the seller is now saying that they think they can get more money, so they’re not going to sell to me. Ideally, I’d like to cloud the title of the property to prevent a sale to someone else. Would a Notice of Interest/Memorandum of Contract do the trick? If so, is there a boilerplate form that I can simply fill out and file myself? Or, do I need to hire an attorney to file a lawsuit and then a lis pendens?

I posted this elsewhere, but I’m thinking this is a better place to ask:

I have a property in PA in my own, personal name that I’m thinking of letting go to tax sale. Will this affect my credit reports in any way?

The property in question has no other liens or encumberances on it and is not listed as a current or previous address on any of my reports. If it sells at tax sale for less than the taxes owed, is there a potential for a deficiency judgment, or does that not happen with tax sales?

 Thanks, Tom. Does it depend on the particular Township/municipality, or is it just standard practice that they don’t report? I thought maybe it would show up as some sort of judgment. I’m probably being paranoid, but I’d hate to screw up my credit.

I reached out to several engineering companies and only this one responded. I sent him the geo-tech report that was done in 2010 and this was his response:

"Mark,

I have roughly reviewed the information you sent me.

I have the following comments:

1. Yes, I can assist you for this project.

2. For a site like this, I would use one of two methods for your new house foundations:

        a. Don’t use excavation to avoid any environmental problem in soils.

        b. Stabilize the soils by grouting and use mat foundation or similar.

        c. Or install mini piles in additional to grouting or without grouting, depending upon the future detail investigation.

3. I may perform 2 additional deep borings to confirm the previous boring information.

4. I need to perform a site visit and need the previous boring location plan.

5. Do you have a site plan or survey drawing for your property?"

I'm trying to get my hands on the boring location plan from the previous testing, which is like pulling teeth. In the meantime, do either of this guy's solutions sound good? Cost prohibitive?
