ok, i will edit this - are you prepared to get sued? are you willing to be a test case? Maybe the best thing to do is ask if they want out of their lease. But depending on where you are located you are opening a huge can of worms and if the tenant decides to lawyer up it will just cost you $$$$

 The point is that the uncle is not my tenant. I understand the rules for tenants and ESA.  But he's not leasing the apartment from me.

Hey BP! 

So we just purchase a property about a month ago. One of the tenants had his uncle staying with him after a separation, he must have started staying there right before we closed and took possession. Well the uncle brought with him two giant german shepherds. After we closed we told them we weren't allowing any pets over 40lb and that would be once we sign new leases. The actual tenants current lease say no pets. 

We gave them to weeks to find a new place for the dogs, they got rid of them before the end of the 14 days. Then today the Uncle asked if he can be added to the lease and now he has a "certificate" that his dogs are emotional support animals. 

After talking with my lawyer he think just telling them we are in a legal binding contract with the tenant, and his contract says no pets, that we can stick with the current lease of no pet policy and won't be be discriminating against anyone because the uncle and his dogs aren't even our tenants. 

Just wanted to get others opinions on the matter. Also, I'm in Illinois if that makes a difference.

Why would you go straight to 'cash for keys'....when you can just evict them...?

 I can't evict them for what they did wrong under the other landlord. I can only evict them once they break the lease with me. So I figured cash for key would give me and empty apartment to fill, vs waiting for her to not pay, then start the eviction process. I'd rather her be completely out instead of taking the risk of her possibly not paying me either.

Would I legally be allowed to offer cash for keys if she leaves before closing? Or since I'm not the owner yet is that not allowed?

We are supposed to be closing on on a property Nov. 22. The seller told us everyone was paid up and no one was behind. We did another walk though inspection with the current manager, and she informed us that one tenant was 5 months behind. 

What should we do? Make the seller handle it? Can we start the eviction as soon as we take ownership? Cash for keys? She's still in a year lease until April. But would rather have an empty unit to fill than a non paying tenant to kick out. Anyone that can help I'd appreciate!!

Hey BP, 

So, we are under contract for a 12 unit property, specifically 2 6-units buildings. We are having a hard time finding insurance, and knowing what would be a good price for it here in central Illinois where it's located. 

We have had some places say they don't do buildings that size, others turned us away saying since this is our first rental property and don't have 3 years of proof of commercial insurance they can't help us. 

Its been frustrating, and we are supposed to close on the 22. So if anyone has some advice or suggestions, or an idea of what the price we should be looking for that would be awesome! Thanks!

I'm in Central Illinois and in my town there are multiple investers putting up their whole portfolios. My husband and I are wondering if these investors know something we don't (laws changing, bigger tax hike...) Or if they are all just unloading them to move out of state. Either way, I always think it's a good idea to exit Illinois (working on it ourselves), so unless they all cash flow an amazing amount now would probably be the time to sell and 1031 them into a better market.

Its a big house, just not set up for house hacking. Our town isn't really Airbnb material so I doubt that would work to well. Our basement would be perfect as a unit, but the only access to it is inside the house. And we have 2 little boys so having someone we don't know inside and living around us wouldn't be a very comfortable situation. If we didn't have kids it would be a great idea tho!

Thank you so much! We actually just bought another one as our 3rd house flip (our first non live-in flip) so we are still chugging along, just not as quickly as we could be if we didn't have this house. 

All of your suggestion are great too, I will speak with our Realtor and see if he can do something like you're talking about. We have also considered trying to FSBO it because we could take even less that way, we just didn't know how effective it would be being the slower season coming up and we're not sure how successful FSBO are vs using a Realtor.
