Thanks to all of you who have responded to my question. I am grateful for any assistance you all have provided. I am going to respond to a few of your questions.
Response to "Kyle J.": About a year and a half ago, I did indeed have a family health hardship and a business financial hardship. At that time was indeed no longer able to make my mortgage payment. Prior to that time, I had never missed a payment of any kind (mortgage or otherwise). I called BofA to work out some kind of modification. Two of their agents told me by phone that the bank could not consider my request because I was making my payments. I would only qualify for their programs if I missed two consecutive payments. Based upon their counsel, I missed payments. I diligently began applying for modifications. About every 3-4 months they would respond by requesting updated paperwork and personal financial documentation. I sent in all items as requested by them. Months would go by and they would request the same docs. After 18+ months, they finally declined me because "I DID NOT PROVIDE THEM WITH THE REQUESTED DOCUMENTATION"! This is absolutely not true! I even submitted the requested docs through an attorney. This tells me that they never seriously considered my modification. All of the above is true. Thus, I make the claim that BofA IS at fault for my situation due to their original counsel to miss my payments and then their lack of communication or consideration of my modification.
Thankfully, I am now able to make my house payment. Despite my best efforts (and that of my attorney), BofA will not respond or accept any of my offers or requests. BofA started a foreclosure. My existing short sale has suspended the foreclosure. I have no desire to do anything illegal but I have no sorrow or pity for BofA. They have helped me 0%.
For this reason, I would like to take the matter into my own hands and purchase my home back from an investor. My goal is not to screw the bank or make a profit. I simply want to keep my home that I can afford.
Is there ANY way that I can stay in my home through a short sale???
