Thank you for all of the advice. I would give her more time if I did not have to live on the property. Per the first home buyer loan I have to live on the property within 60 days. That unit needs to be completely renovated before its livable and I was hoping to do it before winter hits and before my first mortgage is due. I don't know why they are not moving and when I ask, they say they can't find a place, although a quick such on craigslist reveals many places in their price range. And then they told me they were on their way to drop off a deposit but someone else beat them there so the apartment was rented to them... which sounded very strange. I'm pursuing the eviction.

I used my first home buyer loan to buy a 4-plex. Part of the stipulations in my loan is that I have to live on the property for a year and must move in wwithin 60 days. One tenant had voiced to me that she plans on moving in September anyways so I chose to serve her with a 30 days notice. She is living month to month and living off of disability. I served her a notice at the end of July and she had until August 31st to move. She's not even packed. The notice she was served with meet all state requirements. Do you have to give disabled people more time? If I take her to court, will the judge side with her?
