if the owner owes $ 58,000 and the house is worth 80,000 , I want to do an assignment, do I have to get an offer accepted by the mortgage company first or do I get a contract signed with the current owner?

Can I assign a contract on a property that has an existing mortgage on it? Its not in foreclosure yet.
