That was my horrible bad.  I had 5 homes in the process of rehab, and getting renters at the time. It was a busy time last Spring. I let this one get behind because I didn't want to deal with it.  I never have EVER had to deal with folks LIE to my face.  And after about the 4th month, I filed, and then 2 months later got into court (making them 6 months late).

My bad.   I am the only one to blame.  I will not be broken by this.... and move forward.

I am grateful for all of the responses.  I get that I should take the high road, but in the end my family starves.  I get that I should respect the law, but in the end there is none.  I am going to go down the best road, and pay my attorney to finish this off, but this particular instance/ situation was unforeseen.  Who would guess that our government could tell me that I must work harder than ever, and sign my name to a mortgage, and let other people live in that home.

In essence, this is what it is.

Sure, I got more homes.  Yes, I've worked VERY hard.  NO, you don't get to live in ANY of them for free.

The judge ordered the eviction, so get a sheriff to go along and enforce the judge's order.

I would love to just get a sheriff to go along and enforce the judge's order.  BUT, last time I tried this I learned that if they don't voluntarily move out AFTER a court order Eviction, you then go back to the courts to get a WRIT of Assistance to 'allow' the Sheriff to 'Assist' in the Eviction. And since the CDC stepped in I am sure the courts will NOT do anything.  Also, regarding the CDC, on their website they link to a document that renters have access to print off stating that they will become homeless if they are evicted and that's all it takes.

I have already been to court..... several times.  I finally have the EVICTION ORDER.  They must move or else.  Or else what?????????/  The court has made their decision.  But the CDC has made their decision.  So who wins?  I am certain that I will NOT lose.  I am wondering if others are in the same situation, or if everyone is just offering legal advice, as we should all listen to cover our bankrupt asses.

This is a home I completely remodeled, 2 years ago.  Beautiful 3BR/1B home, Great Neighborhood, folks have great jobs! Make great income. More than me. Remember, I have several homes that I own. These folks are good people, just don't pay their bills, including me?! 

I agree, If this is what it has come to, than so be it.  I've spent my money, I've been to court. I've won! I have the eviction order, I have the mortgage payments that I have made without interuption. I will ABSOLUTELY take over my property, remove the doors, remove the toilets,,,,  and GET MY DIGNITY BACK.

I know many won't get this, because you are much more into this real estate thing as professional business folks,  But this is total crap.  And to think that others will just let this go by, and let there life savings go up in smoke like me.  Except I wont.

No not at all.  This has not broken my will. I have several properties, but I am just a mom & pop. I currently have projects going as well as still buying.  HOWEVER.... Since I am being told CDC and otherwise, that I MUST lose money because of a decision, a poor decision that I did NOT make. That me and my family will suffer.  Therefore, since it is my property, and I have no confidence that even after a court order, that NO means of enforcing this order will take place.  That I thought about removing the doors.

I'm sorry, If I mislead you into thinking that this is my only property, and that I have lost my will to own more properties.

Hello All, been a member of BP for quite some time now, but rarely participate.  However, need some folks to chime in on this one.  Have a renter, attempted eviction last year (6 months arrears), court ordered tax checks to me, but when it didn't happen agreed to $150 extra/mo for 60 months.  Now that has been quit and another 3 months non-payment (total of 9) and filed eviction in May..... kept going to court since then but the moratorium tied the hands of the judge..... then granted EVICTION ,,,,,  and must vacate 09-11-2020.

I have ideas..... as I am pissed now, besides being broken financially by this property.  After this CDC garbage, I believe I will show up to my property, and instead of changing the locks, I will hire my contractor to remove all doors in the house and the toilet.

Your thoughts~!!

I applaud you and say "Jump In with Both Feet" and go for it.  I don't know who this Clayton fella is, but I do know that there is a difference between people who read about winners and WIN and people who don't even TRY.  I say go for it!  Do it!  It can be your destiny!  Don't let anyone discourage you........  GO FOR IT!  If you win then GREAT.  If you don't then you have learned.  Get back up, and go WIN!

My story started out by buying a property for 20K selling it for 80K and only losing 15K.  But if I never did that first deal then I would never have learned.

I did not give up.  And I learn every single day.

Yes, I have sold on contract....  my contracts are structured amortized 30 years, balloon at 5, at the time that this contract is satisfied then at that time I will supply Warranty Deed and title insurance etc...  also, NOTE: at the time of contract sale they also sign a quit claim to me and sales disclosure back to me should they ever default along the way.

Now, I have had the bank get my home appraised, and then loan me 80% knowing that I have sold it on contract.  The loan is in my name only and I must pay this monthly regardless of whether my people pay me or not.  Of course if they don't it's a new ball game.

In my recent issue, I had a wonderful home, and good people that simply had problems in the past (some judgements and a bankruptcy)...   my appraisal was being done and the title search showed up that these folks had what I had already known and the whole bank deal blew up for me.

I can only imagine that there must not have been a problem with the folks that I chose for the other homes.....

Anyhow, this has put me in a tight spot as I need the equity that I build into a home to continue to do the next 2-3 deals.  In other words, each home I buy, will buy me 2-3 more depending on my negotiating skills.

Please continue to provide additional help that I appreciate from all!

(simply someone sold us our first home on contract and now we are blessed to do it for others, up until now of course)

Thank you for the replies.  So....  I have done this before without issue.  But I suppose I should have financed the house first and THEN sell on Contract?  Wouldn't that still put the people in the chain of title? 

Yes, everything was done at the law office, and recorded with the courthouse departments.

So, then it is NOT a problem to sell my home that I financed with the bank? to another person thru a contract?....   as for finding a buyer in secondary I am much more interested in the monthly net income from this type of property versus rentals, and I have several contract homes...  I'm just out of money (ooops) other than monthly income I suppose.
