first.... what is the root of the dispute?  Are you backing out of the purchase and is your reason covered in the OTP.... or is the seller backing out and why?  Is there a broker involved?  If so they should work it out with you.   IF you are backing out of the purchase and your reason is not covered in the OTP what is your basis for arbitration?   Depending on the answers may depend on who pays the legal fees.  However....I  am not familiar with CA law ...in PA the magistrate could decide either way.

Are you still in the area and what kind of real estate investing do you do?   I came in from the Washington DC area.  I find this area is unique in what goes and doesn't.   It is not like other areas I invest in.   I am out near Country Junction and in 30 years I have seen minimal new businesses come and a few go.     Lehighton itself has changed little except for the Walmart moving out farther down 443 and Lowes coming in...and a few fast food places... not much.  Center town is fairly dead.    Palmerton seems to thrive but thats Pencor and now the medical boom.   But main street isn't much different over all than it was 30 years ago.    Up the road North in Brodheadsville, if it wasn't for the expansion of the schools which have over the last years shrunk significantly in population... you wouldn't have seen much change.... still you see a lot of vacancies up and down the strip between Lehighton and Brodheadsville, land for sale for decades left undeveloped.   Only recently have seen a bit of a surge in new home construction....but far from the glory days....   If I were you I would do my research very well and pay attention to the local preferences as they do matter strongly in this area.   Would be happy to connect and share experiences.

I moved into the area about 30 years ago too.   I expected greater growth than has happened in that time.   It seems mostly growth connected to St. Lukes or Lehigh Valley Health is about all that is happening and dollar stores.   Not sure exactly where your property is...is it on the Marzens Hardware side or the opposite side of 209?    I would look to see what kinds of businesses usually open up around hospitals.   Seems to me medical professional offices are the usual types of building near hospitals.  In this case these hospitals own their doctors so to speak and provide them offices.    So you are looking for services that cater to those who visit people in the hospital.   Coffee shops, quick gifts,  gas stations I would suspect.    What is out there currently that seems to be thriving is that area?   Look for things that compliment those businesses.       This area is not gaining population.  It is fairly stagnant.  St Lukes isn't changing that much as they are replacing Gnaden Huetten ...not ADDING a hospital .    Gnaden Huetten was there for decades and the only thing near it was doctors offices.    

Most of my tenants are on time.... only 2 out of 13 units are paying partial rent and promise the rest by the 15th.  Keeping my fingers crossed as most live on a financial cliff.

see these posts are really old....hoping someone in the know picks this up.

I have a SDIRA and own a number of properties under it.  Took out a Non-recourse loan to bridge the period of time it was taking to transfer funds into the SDIRA.  The loan was for the total amount including settlement.  I paid off the loan in a matter of weeks.  How do I calculate the investment percentage?   Is it the total loan amount divided by 52 weeks x the number of weeks of the loan?   Can't seem to get my mind around this calculation.
