That said, there is always instances of realtors or attorneys for that matter involved in client funds misappropriation situations.  Hi @Frank Greg, I am sure @Vic Valera is alive and well. His broker just said he will return @Vic Valera's license to the board. I don't think I am getting any further help from the broker. 2 gentlemen have asked me not to waste my time and I think it is wise, but I will have to file my formal complaint and hopefully the board will at least bring some disciplinary action to them, and hopefully, that will stop @Vic Valera from hurting another investor.

@Frank Greg I really appreciate it, Frank! I will include these verbiages in my complaint letter. Especially:

"Reasonable time" in this context means by the close of business the next banking day.

And definitely not 2 months later...

@Frank Greg Thank you for your input, Frank! The broker did not know and was surprised that @Vic Valera was working with me as my property manager (The broker also has a property management company). The broker should be held reliable for the agent's action, as you mentioned, but no one is being responsible at the moment. I will file my complaint and see how the RE Commission board responds.

Hello @Aaron Porter. Thank you for your input. I would think the principal broker will have some liability over the agents he overlooked, as you mentioned. The last time I spoke with the broker, he said all he was going to do was surrender Victor's license. He did tell me I could report to the RE Commission board or the small claim court, so I guess the broker did not think a complaint to the board would affect him. However, what you said makes total sense to me, and hopefully, we as investors can rely on the RE Commission to hold the agents and brokers to their highest standard.

Thank you for your input, Mike,
     The principal broker told me he is going to surrender the agent's license because he couldn't get a hold of the agent, either. I am going to pursue filing a complaint to the MS RE Commission.

Hi all, 

       I have been dealing with a rogue agent, @Vic Valera who took my tenant's rent money and refused to send it to me. Unfortunately, it seems like the only way I can get my money back is in small claim court. However, I am in CA, and it looks like a hassle suing someone out of state. Can someone please share their experience if they have done so before? Thank you so much for your attention and participation.
