Thanks James, looks like I have to look at the other tenants whose lease expires end of January.

So if the lease states 1 person occupancy and he has since moved his wife/girlfriend in, that wouldn't be a change of the agreement to the point where we can change the lease?

The downstairs tenants have been there for 3 years and have a good payment history where the top floor tenants have only been there for about 6 months, and when I was in negotiations the owners understood he was mainly living with his girlfriend and using the property as an address for probation. This is why I was looking at moving them out instead of the downstairs tenants.

I am not a legal expert but a 60 days notice is quite generous because the most you need is 30 days. You are currently only 31 days or so into the eviction notice. So wait out the 60 days to maintain the stipulations in the lease. Once the 60 days is over, start contacting your lawyer to start the process.

But altogether the tenant is wrong and trying to scare you, they can smell a newbie a mile away. Start seeking legal advice now so you can be prepared when its time.

Hi everyone!

Just purchased my first investment property. It's through an FHA loan so I will be living there for a year. The home is fully rented and in the sales agreement it stated that the past owners had to give notice to the tenant to have him moved out. They gave him notice on Nov. 28th and closing just happened on 12/29.

The tenant is now stating that I can't force him out until the lease agreement is up. He acknowledges that the prior owner gave him an eviction letter explaining that it was his 60 day notice on 11/28, but is saying it's illegal. The lease states "The Landlord must provide the Tenant 60 days written notice of any changes to the lease".

Is the tenant right in this scenario? Or does the 60 day notice serve as a written notice of a change to the lease?

The property is in Pennsylvania.
