Thanks @Perry Ivy.  The tenant finally moved out just as we were about to proceed with civil eviction charges.

Thanks for the research, @Account Closed.  My property management says the law changed as of the end of 2015 and there is no longer any criminal eviction in AR, only civil eviction.  Looks like we're going to attempt a variation on what I was thinking and offer the tenant a portion of their deposit back if they'll vacate the property quickly and in good condition. If they won't then they'll have to pursue civil eviction.

I've got a rent house in AR and the tenant is 2 months behind on rent and refusing to leave.  The property management company has given them a notice letter and they have not vacated (and said they will not).  The property management company is telling me the next step is a civil lawsuit.

This is all new to me... can anyone break down how the process will work from here if we go the civil suit route? Are there any options besides a civil suit.  I'm thinking, say, tell the people if they leave and the house is left in good condition I'll give them $500 or something like that.  Is that a good/bad alternative?

Hi everyone! I'm looking for someone who has experience and/or knows the laws concerning tax deeds purchased via the delinquent property tax auctions in Arkansas.  In particular I'm looking for clarity on this statement from the AR Commissioner of State Lands (the agency which conducts the sales):

The conventional wisdom on the internet is that a mortgage is extinguished by the tax deed sale in AR, but the best I can find in the state documentation is the above saying that it may be extinguished.

Does anyone have experience purchasing tax deeds in AR with an outstanding mortgage that can confirm the mortgage was extinguished (or not)?

Thanks for the information, Dale. I'm looking into tax delinquent properties in Arkansas as well.  Have you actually purchased properties in AR?  Have you been through a Quiet Title action?
