I have yet to sign an agreement therefore I am asking. I've spoken to two mgt companies now that have a min monthly fee (% based on rent charged BUT not rent collected).  I know other property owners who have had mgt companies for years who only get paid when the rent is collected so I wasn't sure if this is still the rule or if Covid recently changed the game plan.... Like everything else....

Is it normal for prop mgrs to take a % of the rent charged EVEN if tenant is not paying the full amount due to Covid? Shouldn't it be a % of rent received? Is this a new Covid policy change in response to many tenants who are not paying full rent nowadays?

I am considering removing my property from the rental market, renovate completely and sell. Can I evict a tenant claiming Covid income loss? Do I need a lawyer to handle if tenant is not being responsive? LA County area

How do I as a landlord prove subletting? I received a violation notice of house sharing this past Feb but my lawyer says it has to be violation happening now (I should have evicted her then) but instead I started mediation through LA County DCBA where she actually admitted to subleasing and said she will continue to sublease knowing I cannot use mediation conversations in court.  Otherwise she denies subleasing on email or other communication and says the people there are friends/family housesitting, etc. What do I need to prove subleasing in court? Is an advertisement online of the property enough or do I need an actual copy of the sublease? Not sure how I would get that...

Right, First I have to prove the subleasing. The rent is just a blatant show of how she is making money from the subleasing plus not paying me rent, just wrong and frustrating. 

No cameras that I know of but will ask neighbors. But even with cameras she can say they are friends/family which she has done in the past. 

Also, say everything falls into place and I can evict for just cause for subleasing. Do I have to refund her the deposit even if she owes me more in back rent?  And do I have to wait for Feb 1 2021 (with new Covid rules) to take her to court for rent owed?

I have a tenant who has not lost her job (professor at a private university), is paying the min 25% rent and is subleasing (property is in LA County). It is stated in the lease agreement she cannot sublease but she consistently is (neighbor has told us there is a consistent revolving door of people in and out). I live in SF so I cannot just show up and see who is there. My lawyer needs proof to move forward with eviction for just cause. How can I get proof? I check Airbnb/Craigs list/Westside Rentals constantly to see if the property is listed. ALSO, I just served her the AB 1482 exemption which is technically late (due by Sept 1), will this hurt my chances of eviction even if it is for just cause (subleasing).
