Could goodvalley tell the prospective tenants that he has just accepted the first qualified applicant from those who had applied before this one, and will now return their application fee?

I also think it would be a very informative topic. Not just "is this a good deal?" but what would make it a good deal from a negotiating standpoint. Particularly for newbies. Most people know in theory that everything is negotiable, but specific examples and real life experiences would be great.

The latest on this is that my realtor put a letter in the door of the next door tenant several days ago, saying their landlord is to call him immediately. He did. My realtor explained the situation, and that he would prefer not to have to file a complaint with the city but that the dog is impacting his business in selling the house.

The landlord claimed he never knew his tenants had a dog, that it was against the lease, and that he would tell them to put up a fence immediately or face eviction proceedings. The end result was that the landlord agreed to pay for the fence materials and the tenants agreed to install it by the end of this weekend.

So we'll see on Monday!

I just spoke to my realtor and he will stop by the property tomorrow to talk to the tenant and get the landlord's contact info. If the tenant is not cooperative, he'll go to city hall and get the information. We'll start from there.

Thanks everyone, this is all good advice and I'm going to discuss the options with my realtor and attorney. I agree that I shouldn't have to pay to put up a fence when the tenant's landlord has refused to do it.

In the short term, how would I show the property if the dog jumps the fence while potential tenants, their children, and myself are there? It's not the best enticement to rent the house. I'm wondering if this is a potential dealbreaker for the property. It's my first rental and maybe I'm being over-cautious.

Thanks for the input. I have a message in to my attorney and the realtor.

I just spoke to my insurance company. The underwriter says I have no legal liability for any issues with a neighbor's dog; the owner of the tenant's house would be totally responsible whether I knew about it or not. The dog's owner could also be responsible. That may be fine from a legal/insurance standpoint, but not with helping me sleep at night ;)

I'll need to get the owner's contact name and information, which the city would have on record, and contact him to find out what the situation is.

I haven't had the inspection yet, so I could potentially cancel the contract if it's not satisfactory. The house is being sold as/is, it's highly unlikely the seller will negotiate any $$ for building a fence at this point.

I'd appreciate any input here. I'm under contract for a rental house where the next door neighbor (a renter) owns a large dog. The fence between the 2 backyards is low enough for the dog to jump over, which I saw it do when I first viewed the property.

The dog is large and loud. I asked the tenant if it was aggressive and she said no, it doesn't bite, it just barks. I told her I saw the dog jump the fence into my future yard. She said she asked her landlord to put up a higher fence and he refused. He told HER to do it. So he's obviously aware of the dog and the issue.

I'll be renting out the house, and the renters will have children. I plan to contact the owner of the tenant's house, but I'm sure if I want to protect my tenants, I'll have to put up a higher fence myself. My realtor feels that way too.

Does anyone have any input on whose legal/financial liability it is to contain the dog? The dog's owners? The owner of the tenant's house? Me?

I have, yes. I've also offered group discounts, if 4 or more agents in the same office want their headshots the same day. I'll bring my lights and backdrop to them. If an agent gets 10 or more to commit, his/her's will be free.

I've had agents set a date, only to cancel more than once. Their schedules are so unpredictable that I now require a deposit. And they still don't want to pay :wink:
