Post: mold issue in Atlanta

I have a possible mold claim on a rental property in Atlanta.  The tenant said she might be sick because the house has a moldy smell. I am not aware of any mold issues prior to the purchase of the property three years ago,  The previous tenant didn’t say anything about mold, nor my property manager found any mold or water leak during the last property inspection.  I am not sure if the tenant's lifestyle contribute to the growth of mold.

My property manager will take a second look inside the house.  And I am planning to remediate mold as soon as possible after I receive the mold test result. 

In the meantime, the tenant wants to renew a two year lease.  She's on fixed income and has been paying consistently late for two years.  

Should I renew the lease?  Would anyone share your advice or thought on how you would tackle the issue as a landlord?  Thank you.

Thanks everyone for bouncing your ideas and thoughts.

I just learned from my eviction lawyer that the tenant needs to be gone for 32 days and owes 1 month to be considered abandoned property in Chicago.  I will also need to serve all her known employment place and contact all her personal contacts before posting a five day.  The eviction law is so harsh on landlord here...

I'll ask the lawyer again if I can serve by certified mail.

Hello everyone,

In the past four weeks, I have used two servers to give my tenant a Five Day Notice at the apartment and 3 workplaces without any result.  My property manager thought it was abandoned and went to check the place under 48 hours maintenance notice.  He found the  lock was changed.  Young girl (not on the lease) was there and wouldn't open the door...

The tenant has relatives living in a building across the street.  They might have switched place to live.  I don't know for sure.

This is my first out of state investment in south side Chicago.  I am running out of ideas how to reach the tenant.   Will anyone has similar experience share your ideas and thoughts with me?  Thank you so much!

I just sent my termination letter to my seller/property manager, but I have to wait 30 days to transfer...I am not sure if she will do anything unprofessional at this point.  Could anyone share your insight about what I should watch out for during the process?

My seller/property manager sold me a house in IL with a tenant who was delinquent on the 3rd month after he moved in.  He paid partially since then.  Now he owed me about three months.  I used/paid my PM's lawyer and filed eviction lawsuit under my PM's name.  On the purchase contract, my seller/PM agreed to purchase a rent protect policy in case of eviction, which he never did.  My PM just kept accepting partial rent after a 5 day notice was serviced.  Also, I just recently found out that his team lied to me and instructed this lawyer not to hire private process server.  His lawyer sent me his email communication with the PM.  That's why I know this.  My seller/property manager also threatened to stop managing my property if i insists moving forward with eviction.  I want to move my property out of his management, but I don't know anyone else in Chicago.  I am also worried if I do this, I have to restart eviction under my name.  More time and money will be lost.  My PM might not testify for me in court, since he knows he has to pay for my rent loss and legal fees.
