@Ivonne H. Magdaleno The Florida Realtors association AS-IS residential contract was used on the deal. It wasn't written by an attorney, but an attorney looked it over.  The contract was fully signed and so far nothing in the contract has been breached. I understand it's not common to record a contract with the county, but my understanding is that it's the best action to protect the deal at this point in time. Do you know how to record the contract with the county or is your advice to "speak with an attorney"?

Does anyone know how to record a real estate sales contract with the county? I'm in Orange County, FL. I'm dealing with a seller whom doesn't quite think he needs to abide by the contract he signed and I want to prevent him from trying to sell the property behind my back. 

Any direction will be greatly appreciated.

@Evan Polaski I don't really understand why you'd get an estimate and then a bid... Mind explaining why you'd ask for both? I wanted quote with break downs of the quote, such as demo, electrical, overall appliance install, and finishing touches, so I could take that and derive a draw schedule that makes sense for both parties. This particular GC didn't want to give me anything itemized at all. He actually wouldn't give me any number until his architect created a drawing, which was almost $1000. There's no way I'm paying someone money before I get a detailed quote. 

I'm not asking for "down to the nail" level of detail. I was hoping to get a cost for demo, electrical, appliance install, etc, so I can come up with a draw schedule that makes sense and is fair. If you don't get an itemized quote, how do you come up with an accurate and fair draw schedule?

Have you ever had an issue with getting an itemized estimate from a contractor? I'm beginning to vet contractors and am having an issue finding a contractor that will give me an itemized quote. Any recommendations will be greatly appreciated. I'm in the Orlando, FL area.

@Ken Naim I'm working with the title company to get to the bottom of it. The seller has hired a lawyer and began the probate process. Apparently the courts are a little backed up, so it might take some time(30 day est). My concern is that the probate resolution takes longer than the additional 30 days beyond the closing date specified in the contract, or the seller and his attorney drag their feet on purpose. Do I have a contractual right to wait the probate resolution beyond the 30 day extension or can the seller cancel the contract? I feel that since the delay is on the seller's part, he shouldn't be able to get out of the contract unless it's somehow not possible to sell the property for some legal reason.

The seller thought the probate was taken care of. How would the a realtor know that the property is still in probate without having a title company or lawyer look into it before signing the contract? It's an off market deal. If I have to renegotiate the deal, there's no way I'll get him to re-sign without an increase in purchase price. 

I recently got a house under contract for a single family home. We discovered the house is in probate and will take some time to be resolved, therefore we won't be closing on or before the date specified in the contract. Now the seller wants an additional $10,000 added to the purchase price we originally agreed to. Can I stand my ground and say no to the additional $10,000? My worry is that if I say no to the purchase price increase, the contract can be voided because the closing delay due to probate. Does "Specific Performance" come into play here?

I'm using a standard AS-IS Florida Realtors contract that can be found online with a quick google search. 

Any help you can provide will be greatly appreciated.
