I would definitely recommend consulting with an attorney for options. What is puzzling to me, if I’m understanding correctly, is that the realtor wants compensation prior to closing for drafting a purchase contract. There are many, many transactions that unfortunately fall through for numerous reasons and time and effort is put in by multiple parties who do not seek payment when the deal does not close. It does seem odd that this realtor would ask for compensation for the time and effort of drafting a contract. I would consult an attorney and see if they are able to draft the contract for you, that way there is no need to pay the commission. They should be able to guide you in the right direction. If the homeowner is underwater, it sounds like short sale would be the best option for your seller to walk away debt free and move on. A full short sale package would need to be submitted to any/all lienholders. There may be a chance for relocation assistance (usually $3,000) for your seller at closing depending on who their lender is.
