Hi @Mike Bonadies Thank you for the insight.  Since my post, it appears that the tenant will indeed be moving out tomorrow.  So I do not plan to go the eviction route now.  However, I still want to collect the July rent which they owe.  I noticed there is a collection agency that specializes in collecting rent for landlords and also reports to the 3 credit bureaus called RentRecoverService.com.  Do you know if NJ allows us to use this type of service? Tks!!

Hi All

I have a rental in NJ. I reviewed the NJ eviction regulations and it basically states that I can file an eviction immediately without notice for non-payment of rent.  However, the tenant is supposed to be moving out at the end of this month, so if I file an eviction, wouldn't that extend the whole process and give them extra time?  Note that they used their deposit for last month's rent so there's no security that I can hold over their heads. They were supposed to pay this month, but obviously they haven't.  Yes, I know, this was a mistake on my part, but we had a lot of other issues we were dealing with.

2 questions:

Do I need to send a Pay or Quit notice.  Based on NJ statutes, it doesn't appear that I need to.  I already sent them a non-renewal notice and they are aware that they need to be out by end of July

Should I start the eviction process or can I collect without going that route?  If so, do I just need to contact the Credit Bureaus?

So now, regarding a lawsuit. They usually hinge on neglect. So the question is going to be "where were you as a landlord negligent? I do not really see that you were based on the information given in the post above.

And regarding personal property you would also need to consult a lawyer but i do not believe you will be liable any more than if a hurricane hit the home. It is not something you could have prevented or knew would happen and did not take measures to prevent it.

Thank your for your feedback but I've been a landlord of a FL property for over 13 years, so I understand what it takes to manage an out of state property.  Once the mold remediation is done and the water damage is fixed, I will waterproof the basement, finish it and increase the rent. 

Lesson learned on all the different addendum I  need to add to the next lease and need to review my insurance with a fine tooth comb.

@Patricia Moore Thank you so much for your insight.  It's a lot of food for thought.  I unfortunately did not require the tenant to get renter's insurance, but I plan to add that into the renewal of the lease.  I also plan to add the water and mold issues as an addendum, thanks for that tip!

I'll be calling a lawyer on Monday to settle my mind.

@Brian Pulaski Not exactly sure how long the water was flowing from the pipe, but it seems that it was too much for the pumps to handle and they burned out.  And it's true that they never went down there or checked so I can't be too upset at this situation.  I just don't think I should be liable for their furniture or clothes and especially any health issue since I had no control of the situation.
