Case in point - when I was looking to buy my first home, back in 2009, as someone who never purchased a home before, I asked a prominent agent in my community for help. I ended up finding a condo in Chicago myself, without her, but asked the agent to help me with the transaction anyway. While the condo was under contract she insisted that I don't need an inspection. To her, that would be a waste of money, and inspections are generally not needed for condos?!.
Long story short, I ended up buying that condo, only to find out, after one month, that my living room windows were leaking big time during the stronger rains. It was a horror that I will never forget. When I talked to an experienced contractor and a friend, he told me that would be easily visible during a proper home inspection. Not a single person, or other RE agents, suggested that I should sue my RE agent who advised me not to do an inspection.
So, yes, maybe in theory, agents are legally responsible if they don't work in my best interest, but in practice that's not the case.
