The question I have now is - where do you find notes at a discount?

I am having hard time finding decent notes to invest in even at the face value

First of all, thanks for the reply. 

So, let's say if a note outstanding was $10,000 and all other foreclosure costs $2000,

but the property sells for $15000. I receive only $12000, and the other $3000 goes to the borrower?

Let’s assume you want to invest into a Note secured by a 1st trust deed on a property.

The current title is jointly owned by husband and wife, but the borrower on the Note is only husband.

Are there any legal dangers if it comes to foreclosure?

Let’s assume you have invested into a Note secured by a 1st trust deed on a property.

The deal goes bad, and you have to foreclose.

Let’s also assume that the foreclosure proceeds are more than the note amount.

Is the difference (foreclose proceeds – note outstanding – expenses) taxable and at what rate?
