You file a claim in probate. Find out what the probate number is and hire an attorney or at least file a claim with whomever is the Presonal Representative of the estate. Do so in writing and send the letter referencing the prepayment and send the letter USPS certified, put your copies in a filing folder and hang on and wait. After a few days or so make contact again and find out what the process will be. From there, contact an attorney if they claim you won't be notified for some reason. Otherwise just understand that probate moves slowly most often.


 Thanks, Mike. The third party attorney who was handling this company legal stuff, responded there aren't any funds available its not there. Owner must have done something with it. In this case, should I just contact an attorney to help?

It is customary for the seller to pay the property taxes up through the previous year, and then the taxes for the year of closing are prorated. 

But this can be negotiated different ways. The buyer could offer to pay these to sweeten the deal, or raise the purchase price accordingly to cover the cost of the back taxes.

Hi folks.

If a property is a delinquent real estate, meaning there are overdue property taxes that have not been paid by the seller for the last couple of years, who is responsible for paying those taxes at closing, the seller or the buyer? Any risks here?

Looking for recommendations on DSCR lenders who would do DSCR loans under 100k in Cleveland, OH area. I can qualify for conventional loan, but I'm looking for delayed financing with better LTV and think DSCR loans can offer that. All the folks I have spoken to have $100k min, and searching through the older posts here could not find much leads. Appreciate any guidance!

Thank you @Stephen Dougherty and @Baird King. You both highlighted similar points to use HELOC for short term financing/hold and I understand why. Thanks for providing that clarity.
