sounds to me you should go to the HOA and see what information they would give you...if not contact a real estate attorney or title company to do a title search for you

read you post 1 and 2 sections you are on the right track now with FHA lowering the down payment requirement it would be an excellent time to look into.

@Barry Cooper i would say move your money to the south then again I'm a little bias because I live in the south other factors are also at play i.e. population growth, taxes, and cost of living.

Its sounds to me the banker is coming from his perspective...maybe find out how much mortgage is left if it's less than the 30% down then maybe see about the payoff being the downpayment and the rest of the terms (thier monthly payment) talior it around the cash flow of the building where you can cover expenses, pay them, and make a profit after that a I'm pretty sure a real estate attorney can write everything up. Remember if they're seller financing their the bank.

@David White yeah we have those same jobs posted down here to me I would background check the company to make sure its legit....plus you could just ride the neighborhoods yourself just to get a feel of what's going on

Does the property have a mortgage? If so then you need to find out if its an assignable mortgage which the seller/agent could tell you. If it is to me it all depends on the type of agent you are dealing with to help make the deal happen.
