@Colleen F. thank you for your reply! How would I go about making a check and sending it to both? They live in different states. Two checks made out to both in the amount of half the security deposit? Or two checks full security deposit?

I’ll try to keep it short. I’m subletting a townhouse on Oahu. I have 2 cotenants. For the sake of the post I’ll call them jack and jerry. The lease was for 6 months . I received security deposit and every months rent from Jack for 6 months and then allowed a one month continuation of lease. From Feb 2021 to end of August 2021. Jerry moved out against jacks wishes sometime in June and left Jack with the entire rent amount until end of August. Jerry is now asking me for half security deposit after lease term expires. The question is, how do I divide security deposit if I do so at all? There’s no specific Hawaii law stating how to do so other than return within 14 days. Ive read I could be held liable for co conspiring to withhold money from other tenant if I don’t write one check made out to both of them. Again, both signed the lease but I’ve been receiving all payments from Jacks account however Jerry claims he paid half deposit to Jack. Thanks in advance and sorry for the long post!!

Hi so this is a bit of a long post but I’m new to this realm of real estate. So I currently have a rental unit in my name and I have the landlords permission to sublet. I’m charging a few hundred dollars more a month as sort of a rental arbitration. My question is about disclosure. Do I need to indicate to the sublesees that I am a sublessor in the rental agreement? Essentially should I tell the potential tenants by law that they are subleasing from me or does my leasehold interest in the property give me permission to market it as though I am the “landlord”? Asking as far as my legal obligations if anyone knows since I am unable to find anything specific in the law about drafting the lease. I would prefer to just market it as landlord as people tend to shy away from subleases. Note: I will also be obtaining my real estate license in a couple months so I don’t want to risk “misrepresentation”. I’m under the impression my lease and the landlords permission gives me the right to sublet as an agreement between my landlord and myself, not the business of the new sublettors. Correct me if I’m wrong and I’m open to a verbal beating. Thanks

Hello all! New to bigger pockets found this from a Brandon turner book. I’m looking to sublet on Oahu. I currently have a place in pearl city I sublet but it was a lot of convincing for landlord to allow me to do so. My question is does anyone have experience doing this on Oahu and where is the best place to do short term rentals (30 days or more because of laws) also is it better to try to convince larger apartment complex buildings or smaller duplex’s which are managed by owners instead of property managers? Any advice I’d appreciated!
