Moving forward, the Toledo City and LCHD might include other health hazards such as mold and leaky roofs in addition to the visual lead inspection. 

I've been warning about beyond the lead inspection with a similar Cleveland Ordinance for more than 1.5 years.

At this point, we all wish we only had the lead ordinance to deal with.

@Andrew Fidler   According to the mayor and all city councils, the new ordinance is being drafted. LCHD will grandfather all complied inspections.

@Andrew Fidler you can ask for court fees which is very minimal as the bond was only $500. However, you’ll not be able to recover your attorney fees.  The only other fees that ALL landlords who paid $45 to register their properties might be refundable; that could take years.

A new ordinance is already in the pipeline free of the legal hiccups this lawsuit exposed.

I don’t think the lawsuit requested any financial compensation.  Even if there is any money to be rewarded, it will take many years through the courts to get it.  The cost of litigation will be more than the compansation. 

In the mean time, tHe city is working on an appeal and a new ordinance at the same time.  The city/mayor/ politicians won’t let go of the ordinance especially when children and money are both on the line.

This decision was expected and I'm glad that the judge finally signed off so the city can move forward with a new ordinance. 

As a real estate investor and a lead inspector, I'm looking forward on sharing my experience and my efforts for the last 2 years on the Toledo Lead Task Force to work with the new mayor and the 3 new city council to improve the new ordinance and its implementation.

@Darrell Crosgrove I've been a member of PIN since it started about 2 years and Toledo REIA for many years. I find REIA is a lot more beneficial especially for beginners. The topics, the professionalism and the knowledge you gain from REIA is absolutely priceless.

Just a few minutes ago: 

"Amending the Toledo Municipal Code by repealing the existing Chapter 1760, Registration of Lead Safe Residential Rental Units, and enacting a new Chapter 1760 under Part 17, Title 3 entitled Lead Safe Residential Rental Units and Day Care Centers; and declaring an emergency."

The intent of the ordinance is nobel to better Toledo and beyond.

@Andrew Fidler You had been only to 1 Toledo CC and 1 LTF meetings.  Check the records: ALL CC are in favor of the ordinance and they ALL want it to work. That's including the 3 newly elected last November and the mayor. 

There might be some amended recommendations in the future BUT not anytime soon.  The money generated from the $50/day fine is too good for any politician to pass. That's what's all about and that's why your favorite mayor changed his mind publicly last week.
