Quote from @Kerry Baird:

For background: I have a number of houses held in LLCs and just sold the last house in our own names. I'd keep the property in your own name, get the HELOC and get a good umbrella policy. UNLESS you have a reason to worry about the LLC issue. Your name is already on title so you will be in the chain of ownership. Insurance handles the liability. And LLCs don't change tax situation.

That makes sense thank you! :)

If my rental’s mortgage is under my name and I also took out a heloc for it under my name can I still change ownership of rental to an llc?

The actual question you want to ask is "will I be in violation of the due on sale clause of my loan?". The answer is "Yes, you will be". The followup question is "Will the bank call the loan due?" While not likely, I'm hearing that is happening more frequently and is becomnig more of an issue. There are ways to lessen that from happening, we cover it in the "Due on Sale" article at the link below. But, there are solutions too. It's something that once you learn the ins and outs, it becomes less of a concern.

Yes, that’s what my concern about all this is.. thank you I will check out the article! :)

If I'm using an LLC to purchase a property with a hard money loan, but I am borrowing money from a family member for the downpayment.. How would I receive that money from my family member? Would it go to my personal account and then transfer to LLC bank account or does it have to be some other way? Does it have to be a loan with a contract and interest etc even if it's just someone letting me borrow downpayment money for my first few flips? How would that work? Please advise..Thank you

 Hey Nicholas,

Most Hard Money Lenders do not source large deposits. So you can deposit into your business bank account with a basic LOE stating its a business purpose transaction.

THANKS! :)

Thanks for the help @John O'Leary ! The family member is not on the LLC. So it sounds like I can receive a gift/donation from my family member to my LLC and then move forward just fine right? Everyone says to not mix up personal and LLC funds so I was concerned about transferring funds from my personal account to the LLC account... Thank you
